The presence–or absence–of locus sigilli “[L.S.]” or “[SEAL]” indicators, to validate the signatures in those texts of American Indian treaties collated by Charles J. Kappler in his Indian Affairs: Laws and Treaties, is examined. The results of this inquiry suggest that Kappler spent far more time examining the original treaty documents than Deloria and DeMallie proposed in their Documents of American Indian Diplomacy: Treaties, Agreements, and Conventions, 1775–1979.  相似文献

The inconsistent spelling of American Indian tribal names at the end of the nineteenth century led in part to the development within the Office of Indian Affairs of an array of 270 standardized identifiers, ranging from Absaroka to Zuñi. These efforts paralleled the simultaneous improvement of a large suite of relevant terms by the United States Board on Geographic Names. Both compilations were included in style manuals published by the Government Printing Office beginning in 1900 and approved for the use of federal agencies. In 1903 and 1904, Charles J. Kappler, in the preparation of his multi-volume Indian Affairs: Laws and Treaties, made particular use of this orthography when he created new individual titles for the recognized treaties between the federal government and the Indian Nations. Even with these coordinated attempts, however, versions of the “Names of Indian tribes and bands” register during the last century suffered both exclusions from, and an addition to, the original document from the Office of Indian Affairs.  相似文献

The Annual Reports of the Commissioner of Indian Affairs, for the years 1824 through 1920, described the interactions between the American Indian tribes and the federal government. J. A. Provided a key to these documents found in the United States Congressional Serial Set, but this tool contained a number of errors. One hundred fifty years ago, Joel Palmer, as Superintendent of Indian Affairs for the Oregon Territory, and Isaac I. Stevens, as Governor and Superintendent of Indian Affairs of the Washington Territory, negotiated a series of treaties with tribes of the Pacific Northwest. These 10 instruments have affected the gathering rights of tribes and of others in this area and throughout the United States and have generated a substantial amount of litigation. This article reports on the 512 citations to these specific documents in 354 opinions, between the years 1874 and 2005, in various jurisdictions ranging from territorial courts to the U.S. Supreme Court.  相似文献

Diamond Jenness (1886–1969), New Zealand born and Oxford educated, is best known in anthropology for his detailed studies of Canadian Inuit and Indian societies and cultures. He published numerous reports and papers and the ground-breaking The Indians of Canada (1932), a classic of North American ethnology. Less well known is his service (1926–1930, 1937–1947) as chief of the Anthropological Division of the National Museum of Canada (NMC), where he made important contributions to furthering Canadian anthropology before the discipline had gained public acceptance or a secure niche in either academia or government. Two facts help to explain why little attention has been paid to Jenness's administrative work and the Division's accomplishments during his tenure. First, his career was overshadowed by that of Edward Sapir, among the century's brightest anthropological lights and Jenness's predecessor as chief (1910–1925). Sapir has been the subject of considerable attention in disciplinary history, including assessments of his formative influence on professional anthropology in Canada during his sojourn at NMC (Cowan et al., 1986; Koerner, 1984). Second, Jenness and his colleagues struggled to maintain the Division's viability at a time when economic depression, government bureaucracy, and world war threatened to reduce professional anthropology to insignificance. Though we are not without tangible proofs of the Division's scientific endeavors during the period, perhaps its more notable accomplishment was surviving the onslaught at all.  相似文献

Court decisions themselves, and not just arguments before courts, are rhetorical works. The Supreme Court majority opinion in the publicized 1973 abortion case Roe v. Wade demonstrated this rhetorical nature of decisions both in its choice of arguments and evidence and in its effort to organize symbolically the world of the medical and legal considerations surrounding abortion.  相似文献

The high esteem in which Harvard's Nieman Fellowships are held by the journalism fraternity recently prompted the establishment of a similar program for broadcasters. The initiative was taken by CBS Foundation Inc., the agency for making educational and charitable grants on behalf of CBS, Inc. and its divisions. The Foundation announced the inauguration of an annual program of CBS Foundation News and Public Affairs Fellowships at Columbia University. Since the program has now completed its first year of operation, it seemed appropriate to publish a special progress report in the Journal.  相似文献

The decision of the Supreme Court last June in the “Red Lion”; and “RTNDA”; cases is the most important decision on broadcasting from SCOTUS in many years. On this fact communications attorneys, members of the FCC, editorial writers, teachers, and the Vice President of the U. S. can all agree. To make this landmark decision more readily available, the Journal is providing below most of the verbatim text of the decision. In the interests of conserving space, some minor marked deletions have been made.

The full title of this case is: “Red Lion Broadcasting Co., Inc., etc., et al, Petitioners, v Federal Communications Commission et al. (No. 2)—United States et al. Petitioners, v Radio Television News Directors Association, et al. (No. 717).”; It was argued April 2 and 3, 1969, and decided June 9, 1969, with Mr. Justice White delivering the opinion of the Court. Summary

Fueled by the need to resolve problems in war production and working in the context of New Deal anti-monopoly sentiment, a number of important Senate committees before and during World War II investigated American and other Western corporate ties with German business. Their findings constitute important resources for Holocaust reference. The proceedings and reports of these committces-which include the Subcommittee on War Mobilization of the Committee on Military Affairs and the Special Committee Investigating the National Defense Program-run to many thousands of pages and are located in leading libraries. Careful analysis by researchers may help determine the degree of American and Western responsibility for the Holocaust.  相似文献

In this time of increasing pressure against incumbent licensees at renewal time, all aspects of the renewal process have come into sharper focus and importance. One topic of special interest has been the licensee's “Ascertainment of Community Needs”; section of his renewal form. Hoping to make the process more realistic, the FCC issued revised guidelines on the ascertainment process early in 1971. This issue of the Journal offers four articles exploring the present status of ascertainment, beginning with this overview of a sample of western television licensees which compares ascertainment filings in 1968 (before the FCC Primer) and 1971 (among the first filed afterwards) and demonstrates that the new FCC policy is having a telling effect. A comparative consideration of the Black in the United States with his counterpart in Britain led to the hypothesis that third generation West Indian immigrants in Britain would be vocally identical to local Whites from the same socioeconomic background. The hypothesis was confirmed, and in complete contrast to the American findings, working class Blacks in a British city were significantly misattributed as “Whites” 80% of the time. In addition, data collected on how people of different occupational levels are expected to speak showed that Blacks sounding “White” was far from an inconsistent cognition for many White subjects.  相似文献

The treaties signed by the US and the various Indian nations continue to be powerful litigation tools, as demonstrated in the 1999 Supreme Court case Minnesota v. Mille Lacs Band of Chippewa Indians (526 U.S. 172). Over the years, many cases have been heard but it is noteworthy that of the over 370 Indian treaties enumerated by the Department of State, more than 80 have never been cited in the opinion of any trial at the federal court level. ABSTRACT

Perth-based art dealer Mary Macha was engaged with Indigenous art for almost fifty years. She played a critical role in the development of Aboriginal art in Western Australia firstly in the government sector and subsequently as a private dealer. Her clients included Alistair McAlpine (Lord McAlpine) and Robert Holmes a Court. She was the key player in the development of what became known as the East Kimberley School of art and formed a close relationship with the key artists, Paddy Jamanji and Rover Thomas. After her death in 2017, her archive was sorted and collated by her executors with assistance from the University of Melbourne and vested with the Battye Library in Perth.  相似文献

Among historians in America, Carl Becker attained fame for style in discourse. Although his stylistic prowess was evinced in scholarly works which brought him eminence in his profession, epigrammatic style also was prominent in his writing of popular history, first in a polemic essay called “Kansas” which led to his role as propagandist in World War One, and then—and of particular interest to those interested in mass persuasion—an eminently successful high school textbook, Modern History. The objective of historiography herein is to establish causal relationships between epigrammatic style in those popular works and resultant, rhetorical effects upon Becker's readers mainly in the general public over a span of several decades. Primary source evidence of effectiveness is in letters to Becker, and other correspondence, that indicate which concepts and precise sentences in Modern History were salient and persuasive for a mass readership largely because of the epigrammatic style with which they were phrased.  相似文献

The purposes of this study were: to explore current proposals to ban or limit alcoholic beverage advertising; to examine the method by which the Supreme Court is treating commercial speech cases; to focus on two cases, one in which a state banned local advertising of liquor and wine, a ban that was tacitly approved by the Supreme Court, and another in which the Supreme Court indicated that states have expansive power in the regulation of advertising of products such as alcohol; and to assess policy implications of regulatory concerns. This discussion concludes that ultimately the alcohol advertising issue is likely to be addressed on a state‐by‐state basis and then litigated in the courts.  相似文献

The Examiner papers, the Conduct of the Allies, the History of the Four Last Years of the Queen, and the other productions which Jonathan Swift composed during his years as chief publicist for the Tory administration of Harley and St. John (1710–1714) are among the most effective examples of persuasive discourse in the history of British political pamphleteering. Much of this effectiveness is attributable to the skill with which Swift‐steadily aware of the prejudices and demands of his predominantly rural and conservative audience—manipulated such specific rhetorical devices as imagery, anecdote, analogy, historical example, allegory, insinuation, and other such items from the vast catalogue available to the polemicist.  相似文献
