Globalization and its influence on legal education is a topic of growing interest to the legal profession and to legal educators alike. The first articles on the subject appeared in the mid-1990s, and the frequency of publications has been increasing ever since. This bibliography provides annotations to English-language law journal articles published between 1995 and 2008 that focus on the impact of globalization on legal education in the United States.     

Citation Abuse and Legal Writing: A Note on the Treaty of Fort Laramie with Sioux,etc., 1851 and 11 Stat. 749

The Treaty of Fort Laramie with Sioux, etc., 1851 was an important transaction between a number of American Indian tribes and the federal government. However, because of administrative mishandling by the latter, there has been sustained but unwarranted confusion over whether the treaty was a valid one. Uncertainty led to the use of a brief note in the Statutes at Large, at 11 Stat. 749, instead of the treaty's full text as the law of the land. The Statutes cue, however, has been misused frequently in the opinions of various jurisdictions, even to the point of deploying it to reference specific quotations from the full document—that is, to material certainly taken from an alternative source. This article investigates the most significant citation errors to 11 Stat. 749, and uses them to discuss improvements to applications of legal writing.

Abstract

This article analyzes the role of national bibliographies—with particular reference to the Italian National Bibliography—as relevant tools for national bibliographic control. In the first part of the article, the historical and scientific context of international standards is summarized. The second part describes the role played by the Central National Library of Florence (BNCF) in the realization of the bibliographic control of Italian publications. The limits and the potential of the Italian National Bibliography produced by BNCF are highlighted and compared with the Italian National Library Service (SBN), which is the most important national collective catalog among Italian libraries.

Electronic Legal Deposit in the United Kingdom

The Legal Deposit Libraries Act 2003 introduced for the first time in the United Kingdom a statutory basis for the collection by the legal deposit libraries of non-print, principally electronic, publications. Since the establishment of the Legal Deposit Advisory Panel in 2005, progress has been made in starting to turn this enabling act into reality, through a mixture of voluntary codes and statutory regulation. Work so far has concentrated on three categories of materials, offline, “free Web,” and electronic periodicals, and on the conceptual division of the remainder of the universe of electronic publications. Electronic deposit introduces several issues not present in print deposit and new dimensions to more familiar issues, including detailed involvement of the publisher in setting up the deposit process, “territoriality” (the place of publication), electronic user access, digital rights management, digital preservation, and data protection.
