假冒商标罪的重新界定及其惩治规定述论

1983年实施的《中华人民共和国商标法》是一部重要的法律,它标志着我国保护消费者合法权益与商标管理开始法制化。到1992年底,全国有效注册商标总数达36万件,跃居世界前10名,成为商标大国之一。然而,近年来社会上的不法之徒和少数生产经销单位无视《商标法》的现象依然存在。据国家商标局披露:1991年全国工商行政管理机关共查处商标侵权和假冒商标案件16158起,比1990年增长21.5%;最高人民检察院指出,1992年上半年全国假冒商标案件达1340起,比1991年全年案件又增加408起。因此,加强全民商标意识,打击和严惩假冒注册商标犯罪活动,对于切实保护注册商标专用权,保护社会主义市场经济的健康发展,无疑是十分重要的.     

商标法修改与商标管理课程教学

自《中华人民共和国商标法》1982年颁布、1983年3月1日正式实施以来,随着改革开放的不断深入,我国经济形势发生了翻天覆地的变化,商标领域出现了许多新矛盾、新问题。如《商标法》的一些条款,已经不适应形势发展的要求,需要修改;一些新的内容需要补充;一些原则性的规定需要进一步明确和具体化。而商标管理教材相对滞后的现况,则给商标管理课程的教学提出了新的课题。本文仅就这方面的问题谈几点粗浅的看法。 一、商标法颁布以来的成就与存在的问题 商标法颁布15年来,各级工商行政管理部门以《商标法》为武器,同各种商标违法行为进行了坚决的斗争,有力地维护了商标所有人和广大消费者的合法权益,对建立正常的市场秩序和保证我国商品经济的健康发展起到了积极的任用。15年来,国家工商行政管理局先后完成了商标注册用商品和服务分类由国际分类向国际分类的     

动漫企业商标战略的实施

目前我国动漫企业商标意识薄弱。针对这一问题,结合动漫企业在商标注册及使用实践中的具体情况,通过对动漫企业在商标申请注册、商标有效使用及打击商标侵权等方面的分析,可以认定,只有实践商标战略,充分发挥商标在企业发展中的作用,动漫企业才能在知识产权保护方面变被动为主动,不断提升企业竞争力。
