宪法与刑事诉讼法关系研究——以英、美、德、日为对象

与其他部门法相比,刑事诉讼法与宪法的关系最为密切。但由于各种因素的影响,不同国家的宪法与刑事诉讼法之间关系的表现形式并不完全一样。在英国,宪法与刑事诉讼法平行分立;在美国,宪法与刑事诉讼法呈现一体化;在德国,刑事诉讼法是国家基本法(宪法)的测震器;在日本,刑事诉讼法被看做是应用宪法。宪法与刑事诉讼法关系的不同样态,直接影响着宪法权利在刑事诉讼法中的贯彻落实,影响着刑事被追诉人诉讼权利的保护程度,因此,有必要对有代表性国家的宪法与刑事诉讼法关系进行深入研究。     

宪法与刑事诉讼法关系类型分析

世界各国宪法与刑事诉讼法的关系各异,总体来看有紧密型和分离型两种关系模式。在每一种关系模式中,由于宪法与刑事诉讼法的具体链接方式上的差异,紧密型关系模式中有一体型和统领型两种类型;分离型关系模式中有分立型和松散型两种类型。宪法与刑事诉讼法关系类型是权力与权利关系的反应。
