This paper uses treaty minutes and correspondence from the Papers of the Continental Congress, 1774–1789 to trace the development of a United States treaty protocol with American Indians from its origins in 1775 through the end of the pre-federal period. This examination draws on reports of treaty negotiations, speeches from council proceedings, reports, and letters from Indian Commissioners, agents, Indians, and the Continental Congress to portray the changing cultural context of treaties between the United States and the Iroquois, and by extension, American Indians.  相似文献

The inconsistent spelling of American Indian tribal names at the end of the nineteenth century led in part to the development within the Office of Indian Affairs of an array of 270 standardized identifiers, ranging from Absaroka to Zuñi. These efforts paralleled the simultaneous improvement of a large suite of relevant terms by the United States Board on Geographic Names. Both compilations were included in style manuals published by the Government Printing Office beginning in 1900 and approved for the use of federal agencies. In 1903 and 1904, Charles J. Kappler, in the preparation of his multi-volume Indian Affairs: Laws and Treaties, made particular use of this orthography when he created new individual titles for the recognized treaties between the federal government and the Indian Nations. Even with these coordinated attempts, however, versions of the “Names of Indian tribes and bands” register during the last century suffered both exclusions from, and an addition to, the original document from the Office of Indian Affairs.  相似文献

This article traces the history of the enumeration of American Indians by the U.S. Census Bureau and its predecessors. It considers the social and political background of the census and the reasons that Native Americans were not counted by the census until 1890. It also examines the changes in the enumeration and definition of Native Americans—key concepts needed to provide effective reference service for users of Census Bureau data.  相似文献

In October 2003, Californians voted in the high-profile gubernatorial recall election and on what is referred to as the “Racial Privacy Initiative.” The Initiative sought to prohibit the gathering of racial data in education and state employment. Unlike recent such initiatives addressing California's racial laws, this one was unsuccessful: 62 percent of voters said no. This essay examines the discourse surrounding the initiative over its three-year history and traces the rhetorical dynamics that led to its defeat. The analysis details the implications of this moment for hegemonic processes in general and as they relate to the specifics of race.  相似文献

Over the past three decades, discussion of government documents on American Indians has emphasized federal agency documents and archival records. Despite the fact that Congress has the ultimate authority in Indian affairs, document librarians have not explored the considerable research potential of hearings as a format for information. This article will show, with examples from early twentieth century legislative and oversight hearings, that there is significant untapped research content on American Indians in congressional hearings.  相似文献

The presence–or absence–of locus sigilli “[L.S.]” or “[SEAL]” indicators, to validate the signatures in those texts of American Indian treaties collated by Charles J. Kappler in his Indian Affairs: Laws and Treaties, is examined. The results of this inquiry suggest that Kappler spent far more time examining the original treaty documents than Deloria and DeMallie proposed in their Documents of American Indian Diplomacy: Treaties, Agreements, and Conventions, 1775–1979.  相似文献

Charles J. Kappler (1868–1946) is known almost exclusively for his Indian Affairs: Laws and Treaties compilation, yet his life and his career were much fuller. Besides serving as Clerk for the Senate Committee on Indian Affairs, he was co-counsel for the Pious Fund of the Californias v. Mexico proceedings before the Permanent Court of Arbitration in The Hague and, in one role or another, played a substantial part in many significant federal Indian law cases before the United States Supreme Court in the years leading up to the establishment of the Indian Claims Commission. A digital Web site has been developed to present lesser known aspects of his personal and professional life.  相似文献

The current study investigates how social media affordances influence individuals’ source credibility perceptions in the presence of risk information, specifically examining how bandwagon heuristics interact with different identity heuristics at the individual level. The MAIN model and warranting theory serve as the theoretical framework to examine the effects of bandwagon cues and identity cues embedded in retweets and users’ profile pages for health and risk online information processing. A posttest-only experiment with a self-report questionnaire was administered to participants. Results indicate that different online heuristic cues impact the judgments of competence, goodwill, and trustworthiness. Authority cues strongly influenced source credibility perceptions. A reverse-bandwagon effect was observed in influencing source credibility judgments.  相似文献

The Annual Reports of the Commissioner of Indian Affairs, for the years 1824 through 1920, described the interactions between the American Indian tribes and the federal government. J. A. This essay focuses on the language of domestic radicalization as it has been invoked in recent debates regarding homeland security and the specter of homegrown Islamic terrorism. The language of radicalization is not new. However, beginning in 2004 and 2005 this language began to be appropriated into legislative and law enforcement discussions of domestic terrorism and national security. Using the rhetorical figure of polyptoton as a critical frame, this essay explores how the language of radicalization has evolved and how it has come to shape available arguments and define the legitimacy of participants (and non-participants) within recent congressional hearings and legislation.  相似文献

Supplemental articles and supplementary treaties were used as tools to modify American Indian treaties. In general, supplemental articles were adjustments to the parameters of a treaty, frequently made as quickly as the same – or the next – day of negotiations, whereas the task of a supplementary treaty was to affect the conditions created in a previous treaty(s).As the law of the land, these materials have been referenced in the opinions of the federal, state, and territorial court systems. This article identifies those 80 documents – a combination of 39 initial treaties and their 41 supplements – cited in the opinions of 101 cases between 1831 and 2000 that bind together these instruments, their modifications, and their application within these various venues.  相似文献

This essay addresses the need for organizational communication scholarship to come to terms with the contested nature of globalization through analyses of collective resistance. We argue that organizational communication has largely situated the study of resistance at the level of the individual, and characterized it as an element of micro-politics located within organizational boundaries. Thus, resistance has been considered in localized, interpersonal terms, without full appreciation of its political and ideological significance. This essay builds a case for reconsidering resistance in order to study “globalization from below” and highlights protest movements as exemplars of transformative resistance. Finally, the essay advances a study of organizational communication with expanded disciplinary engagement with respect to globalization.  相似文献

This paper explores how White viewers' perceived portrayals of African-Americans and Latino-Americans on TV influence their real-world feelings and beliefs about these outgroups, which in turn affect their support for race-targeted policies. A computer-based survey (N=323) included measures relating to perceptions about racial/ethnic groups on television, real-world stereotypical beliefs, prejudicial feelings, and support for affirmative action policies. The affective-cognitive model of policy reasoning presented in this paper extends and improves upon prior research in several ways. It considers intergroup emotions as an important mediator by including prejudicial feelings toward racial/ethnic outgroups in the path analyses. Unlike past research that typically grouped all negative stereotypes into one global measure, this study explores how specific types of stereotypes such as criminality and laziness work independently and simultaneously to influence policy preferences. Finally, this integrated cognitive-affective model of policy reasoning is applied to both perceptions of African-Americans and of Latino-Americans, which provides greater confidence in the applicability of the model. Implications of the results and directions for future research are discussed.  相似文献

Federal Indian policy in the United States historically reflects both the hard-headed pragmatism of the nation and its quixotic romanticism. Researchers can identify roughly drawn policy epochs and policy motivations, but there were no clean slates as policy shifted. The legal history of a tribe reflects the accumulated—and often contradictory—impact of changing federal policy. Complexity was added to the government's approach by the application of single-minded policies to the exceedingly diverse native groups within the nation's borders. An understanding of evolving federal policy offers useful insights and a basis for creative legal theories.  相似文献

Although neuroscientifically informed mothering advice manuals published in the past 15 years speak in the languages of liberation, empowerment, and self-realization, I argue that they ultimately imbricate women in ever-more-dense networks of authority, expertise, and government, and contribute to the proliferation of entrepreneurial models of self-conduct that comprises the defining feature of American neoliberalism. This rhetoric situates motherhood as a practice of freedom, both drawing from and contributing to affective forces that suture freedom to economic models of conduct. Through these discourses, emotion-centric, self-interested mothering practices become a key site for the production and reproduction of entrepreneurial selves.  相似文献

The following study examines the influence of racial representations in violent video games upon stereotype associations. Participants were assigned to play either a violent video game with a stereotypical African American avatar or a Caucasian avatar. Following game play, participants completed several measures related to aggression and an implicit association task. The results showed significant differences between the conditions for IAT response times. African American participants showed faster response times to stereotype associations of African Americans than participants who played as a Caucasian avatar. The results also showed a significant interaction effect between participant race and avatar race for aggressive affect.  相似文献
