论家庭暴力法律救济机制

家庭暴力是一个贯穿古今的全球性问题,得到了全世界各个国家的广泛关注,各国纷纷立法预防和惩治家庭暴力犯罪,我国也于2016年3月1日起施行《中华人民共和国反家庭暴力法》。在立法、执法、司法上打击家庭暴力犯罪,建立和完善我国家庭暴力法律救济机制,有利于保护家庭成员的身心健康和合法权益,有利于婚姻家庭的幸福,有利于社会的稳定和发展。     

关于我国反家庭暴力立法的思考

保护妇女合法权益,促进男女平等已成为国际社会不可逆转的历史潮流,世界各国已纷纷加强了反家庭暴力立法。我国在这方面起步较晚,至今尚无专门的反家庭暴力法,目前的家庭暴力救济措施还存在法律冲突且缺乏可操作性。因此完善反家庭暴力立法,建立社会共同的反家庭暴力网络迫在眉睫。     

论家庭暴力及其法律规制

作为一个全球性的社会问题,家庭暴力在我国也普遍存在,对家庭暴力进行法律规制是我国面临的重大课题。文章在对家庭暴力进行界定的基础上,探讨了我国家庭暴力的现状,并对我国家庭暴力的成因进行了分析,进而介绍了我国家庭暴力法律规制的现状,并指出其存在的不足。针对我国家庭暴力法律规制的不足,文章提出了完善建议:完善家庭暴力的民事责任制度,完善警察介入家庭暴力,健全家庭暴力的刑事规制,制定《反家庭暴力法》。     

试述当前我国家庭暴力的现状、原因与对策

家庭是社会成员的重要组成部分,日益严重的家庭暴力危害了受害者的身心健康,侵犯了受害者的合法权益,破坏了社会稳定和谐.本文对我国家庭暴力的概念和现状进行概括,从历史原因、社会原因和法律原因三方面对家庭暴力的成因进行分析,最后从进一步完善立法和加强执法力度、广泛开展反家庭暴力的宣传教育、建立专门的家庭暴力法律援助机构、建立多层次的家庭暴力救助渠道四个方面对家庭暴力的相关对策提出肤浅的认识.     

浅析婚姻暴力

婚姻是人生最重要的组成部分，婚姻中的家庭暴力是一个不容忽视的问题，它严重阻碍了社会的发展和进步。对于婚姻中的家庭暴力方面的立法及救助措施。各国的专家、学者及立法机构对该问题的研究尚处在探索阶段，也就没有形成一整套调整婚姻中家庭暴力的法律体系。本文着重论述婚姻中家庭暴力产生的原因，法律体系中的缺陷及法律救助几方面的内容，以期待一套完善的反婚姻家庭暴力法律法规的出台。     

遏制家庭暴力的立法研究

我国现行法律法规的内容对遏制家庭暴力的发生存在一定的缺陷,结合我国现有的反家庭暴力现状,提出反家庭暴力的立法对策,主要从制定专门法律、起诉权归属、保护制度、干预措施等方面进行完善,以期通过完善立法的方式遏制家庭暴力。     

论我国《反家庭暴力法》的进步与完善

家庭暴力是损害家庭与社会和谐的危害行为,各国都极为重视对其的法律规制。2016年3月1日我国《反家庭暴力法》正式施行,作为我国第一部专门的反家暴立法,其进步性明显,但该法仍需接受检验,并在实践中不断改进和完善其不足之处,从而使其更具保护力和执行力,切实发挥应有的作用。     

浅论家庭暴力的原因及对策

近年来,随着家庭暴力的日趋严重化和公开化,家庭暴力的危害性已逐渐为人们所认识。预防和制止家庭暴力已经引起各级政府和全社会的普遍关注,反家庭暴力立法的呼声日益高涨。家庭暴力产生存在主观和客观的原因,而家庭暴力不仅给个人的身心健康造成伤害,同时也不利于社会的安定团结。解决家庭暴力问题,涉及社会、法律、政策等许多领域。尽快建立起道德、法律、社会、等各层面的社会支持体系,才能有效遏止家庭暴力。

我国家庭暴力的深层原因是妇女的合法权益受到夫权侵害,相关立法不完善。防范家庭暴力:应充分发挥妇联在反家庭暴力方面的独特作用;确立与婚姻法相配套的惩治家庭暴力的实施细则;提供相配套的社会性的帮助措施;借鉴其他国家有关立法、执法中惩治家庭暴力的成熟经验;提高社会全体成员的法律意识。

随着我国反家庭暴力法的出台,妇女和儿童在家庭暴力中的权利保护得到了社会上的广泛关注。《儿童权利公约》首次对儿童人权进行定义,各国对于家庭暴力事件中受害儿童的保护和法律规定也日趋完善。本文结合国际社会对于家庭暴力中儿童人权维护的法律实施措施,反观我国在维护家庭暴力中儿童人权的现状并给出完善建议。

The Reader Response Approach to Teaching of English Literature

During interview with English majors, it was found that a majority of students expressed disappointment with their experience of English literature classes. Students' dislike of learning English literature appears to be the major problem of teaching English literature in China. Reader response approach is a good way to solve this problem. In this paper, I explain the rationale behind the reader response approach, such as its origin, definition, features, assumptions, and strategies. Then I illustrate how reader response approach works as a teaching strategy by presenting several teaching models. At last I evaluate its usefuiness for teachers and present the advantages of reader response approach in Chinese context.
