儒家伦理影响下的家庭结构——以《儿女英雄传》为例

文章以《儿女英雄传》为例，从“父亲的地位”和“礼的的地位”两个角度阐述中国儒家伦理影响下的家庭结构。“父亲”这一概念，在中国文化背景的传统家庭中，除了高高在上的地位的体现，其意义还体现在家庭的继承关系上，包括生殖意义上的继承关系和儒家伦理道德的继承关系。通过对《儿女英雄传》中纳妾、婚礼仪式等的分析，阐明儒家伦理中的“礼教”观念和以儒家伦理为核心的大众文化山理。     

儒家礼学及其对中国社会秩序的影响

礼学是儒家学说的核心组成部分,中国素有“礼仪之邦”的称号,儒家礼学在其中发挥了决定性的作用。中国传统的礼涉及宗教、道德、政治、法律等社会生活的各个方面,包括风俗习惯、社会政治制度、社会道德规范等多方面的内容。本文旨在分析传统儒家礼学的形成及其社会功用,阐述儒家在制度化的过程中如何建构传统社会秩序,并结合当代实际,论证儒家礼学对建立当代和谐新秩序的的价值和启示。     

试论儒家礼刑观对西夏刑事法律制度的影响

作为中华法系在中古时期的典型代表，西夏法律不可避免地受到儒家思想的影响。西夏刑事法律制度借鉴了儒家“德礼为刑罚之本、刑罚为政教之用”的礼刑观，在罪名设置上严惩“十恶”及其他有损伦理纲常的犯罪，并通过限定亲属犯罪来维护家族伦理关系。在刑罚的适用上，强调“明德、慎刑”试图通过恰当的教化使民众服从；在处理统治阶级内部关系上，亦遵循儒家一贯的“士庶有别”的等级观念制定特权法。西夏法律制度在其漫长的发展中，吸收借鉴以“礼”为核心的法律文化与自身法律文化相融合，从而成为中国法制史上一颗璀璨的明珠。     

儒家伦理的世俗化

传统儒家伦理是世俗伦理，它与世俗的结合或者它的世俗化进程有着合乎传统社会经济、政治和自身特点的机制，这一机制是由政治、教育、民间信仰等共同组成的。传统儒家伦理的世俗化不是儒家理想的实现，这其中有着儒家伦理思辨化带来的负面影响，因此包含着对自身否定的因素。传统儒家伦理世俗化对我们当代的道德建设能够提供一些教训和启示。     

论礼与儒墨两家的历史命运

礼是中国传统化的主要模式，儒家继承殷周以来的礼化传统，并有所创新；墨家对儒家所继承的礼化传统予以批判，这必然受到已深入人心的传统化的抵制。儒家继承了礼化对秩序追求的特点，对社会秩序的整合符合了统治的需要；而墨家的秩序结构缺乏理论的建构，其兼爱思想更是难以实现的空想。儒家重视礼的饰作用；墨家却认为超出人基本生活条件之外的饰活动都是不必要的，从人认识自己的存在和社会的发展规律来看，儒家的理论比墨家具有更大的合理性。     

论儒家礼文化的特点及内涵

儒家礼文化主要是对五帝时代的社会礼文化的继承,儒家的礼乐文明使中国早在两千多年前就步入了伦理社会。儒家礼文化的特点是“仁”、基础是“中庸之道”、主要内涵是“礼”和“乐”。宽容他人、尊重他人,为他人考虑,是儒家礼文化的基本规范和标准,人与自然和谐、人与人的和谐是儒家礼文化的最高追求。     

儒家伦理法特征与价值

以儒家伦理法为核心的中国传统法律思想,是在社会生产生活、政治法律制度、正统思想学说的长期积淀中孕育而生的,体现了中华民族独特的气质和心理,包含了中华民族特有的法律心理与法律意识,彰显了"东方特色"的法律精神品格。笔者旨在略论儒家伦理法的特征与价值,以期为中国法治现代化提供借鉴。

“礼”是中国传统文化有别于西方文化的特质，是中国传统文化的核心。“三礼”，是指《仪礼》、《礼记》和《周礼》这三部非常重要的儒家经典。“三礼”是我国古代礼文化的主要载体。     

从清《刑案汇览》看法律层面的以儒摄佛

儒教血缘社会“君君,臣臣,父父,子子”的注重等级秩序的世俗伦理——政治传统,需融摄佛教“出家”以求涅檠的出世宗教文化,这在我国古代精神文化、社会制度方面都有体现。剖析清《刑案汇览》和《大清律例》中的涉佛案例和相关法律规定,可见其法律制度有两方面的体现了以儒摄佛：一是对僧人更强化儒家伦理之实行。僧人同俗人一样要服从法中之“礼”,并要服从合于“礼”之精神的法中之“戒”;二是防范僧徒冲击儒家政治、社会秩序。为切断佛教与民间宗教之间的联系,严防僧人传播“不经”思想,严防僧人结社。     

简析中华传统武德的儒文化内涵

儒家文化是中国传统文化的核心。它自汉武帝＂罢黜百家,独尊儒术＂以来便一直居于主导地位,且广泛而深刻地影响着中华民族历史的各个时期。中华传统武德正是在儒家文化的熏陶下逐渐发展起来的,并形成了自己独特的伦理文化。中华传统武德彰显了儒家＂仁＂的精神内核,蕴涵了儒家＂义＂的伦理精髓,富含了儒家＂礼＂的精神要旨,凸显了儒家重＂信＂的伦理观念,映示了儒家尚＂勇＂的仁德践履。当前,加强武德教育,对提高习武者的道德修养、培育人文精神和构建社会主义和谐社会具有重要的现实意义。

The Reader Response Approach to Teaching of English Literature

During interview with English majors, it was found that a majority of students expressed disappointment with their experience of English literature classes. Students' dislike of learning English literature appears to be the major problem of teaching English literature in China. Reader response approach is a good way to solve this problem. In this paper, I explain the rationale behind the reader response approach, such as its origin, definition, features, assumptions, and strategies. Then I illustrate how reader response approach works as a teaching strategy by presenting several teaching models. At last I evaluate its usefuiness for teachers and present the advantages of reader response approach in Chinese context.
