当代中国法律移植认识的基调演变——基于学术史的考察与展望

当代中国关于法律移植的认识深刻地镶嵌于时代背景之下,历经了正名法律移植、设计法律移植和否思法律移植三个阶段。这三阶段既是一种历时性演进、推演张开,又是一种共时性的存在、陈陈相因。设计法律移植和否思法律移植阶段所呈现的"二元对立式的法律移植观"使法律移植的认识面临着一系列的困境。当今"现代性"与"全球化"的深入展开成为目前中国所处的最为显著的新时代背景,使以往影响法律移植的因素发生了改变。法律移植的认识由此面临着逻辑转换。在以往对法律移植认识的基础上以及新的时代背景之下,"实践理性法律移植观"力求做到移植过程中工具理性与价值理性的统一,把法律移植放入全球化和现代性的整体性格局中去考察和评判,以形成一条既与全球法律文明相沟通又具有民族特色的法律发展道路。     

试论法律移植的主体

本在明确法律移植主体问题既是我国法制建设和社会发展的需要，也是法律移植秩序化和我国法律体系完整性要求的基础上，从狭义的法律移植角度和宽泛的法律移植角度对法律移植主体构成进行阐述，认为法律移植主体应依法拥有法律移植权，而法律移植权属于立法权的范畴，故法律移植主体应具有专属性，就我国法律移植的现状而言，我国应尽快地法律中明确法律移植权的归属，使法律移植主体合法化、规范化。     

试论法律移植应遵循的原则

法律移植的原则是指法律移植理论的初始原理，是法律移植活动的领导性规定。在我国，法律移植应遵循科学性原则、合宪性和法制统一性原则、变通原则和适时、适量、适度原则。这些原则对立法慎重移植、保证移植的成功以及克服法律移植的诸多弊害，使法律移植顺应并促进整个社会的发展将起到积极的作用。     

关于法律移植过程中的几个问题--以近代日本明治时期的法制改革为例

法律移植是国家创建法律过程中的常见现象。近代以来，许多非西方国家在西方列强武力和明的双重冲击下，为实现本国的现代化实施了以西方法为楷模的法律移植活动。日本被认为是成功移植的典型国家。但是，通过对移植对象的选择，移植过程中对本土资源和外国法的认识、处理，以及移植的效果等的研究，可以认为近代日本的法律移植并不完全成功。日本明治时期法律移植活动过程中出现的一些问题，对当前我国建立市场经济法律体制的立法活动仍具有一定的借鉴价值。     

"诊所式"法律教学模式本土化反思

“诊所式”法律教学模式作为一种舶来的新型教育模式，对于中国法学教育的改革和完善具有重要的借鉴价值。但“诊所式”法律教学模式的生成背景、培养目标、教学方式和评价体系等方面与我国传统的法律教学模式存在诸多差异，这给“诊所式”法律教学模式的本土化带来了相当大的不便。“诊所式”法律教学模式在中国的命运取决于能否弥补这种差异，并且实现外来模式与本土模式的有机契合。     

清末变法修律的历史思考

清末变法修律是中国历史上的一次大规模的法律移植活动。实证表明，清末变法修律虽然是我国法制史上浓墨重彩的一笔，但它毕竟是一次不成功的法律移植活动，给我们留下了深刻的历史教训，这对我国法律现代化有重要意义。

从法律移植的方式入手，提出了当代中国法律移植的必要性和可能性，并从法制度的继承性、法律制度与政治、经济的关系等方面进行了具体论述。

诊所式法律教育自美国引入我国后,其发展在取得很大成绩的同时仍面临着移植我国的可行性问题、定位问题、经费问题、师资问题等。要探讨诊所式法律教育在我国发展和完善的突破之路,首先须明确诊所式法律教育目标的取向,接着进一步探讨诊所式法律教育具体困难的突破机制,最后构建高校尤其是非重点院校法学院系推广诊所式法律教育的方案。

法律移植的基本含义是：在鉴别、认同、调适、整合的基础上，引进、吸纳、同化国外法律，使之成为本国法律体系的有机组成部分，为本国所用。实践证明只要移植的法律能适应接受国自身的发展需要，法律移植就会成功。法律移植是我国法律改革的手段之一，我们既要看到它的必要性和可行性，又要注意到它的复杂性
