工伤事故损害赔偿中双重请求权处理的建议

浅议工伤保险基金对第三人的追偿权——兼评我国《社会保险法》第42条之规定

我国《社会保险法》第42条规定了由于第三人的原因造成工伤,由工伤保险基金先行支付医疗费用,支付后工伤保险基金有权向第三人进行追偿。该规定对工伤保险基金的先行支付设定了过于苛刻的条件是＂第三人不支付工伤医疗费用或者无法确定第三人的＂;同时,该条款规定,在医疗费用而不是全部工伤保险待遇上由工伤保险基金先行支付并可以行使追偿权,因此,并没用全面规定我国民事赔偿与工伤保险之间的适用关系。但该条款关于工伤保险基金的先行支付和追偿权的规定也为完善民事赔偿与工伤保险的适用关系提供了一种解决途径。     

论工伤保险赔偿与侵权赔偿的关系

工伤赔偿救济从一元制向二元制发展,形成了工伤保险赔偿与侵权赔偿并存的局面.现行法律却对工伤赔偿法律适用问题没有作出明确的规定,司法实践适用不一,严重影响了法律的统一性.在私法和社会法适用并存时,应在兼顾公平合理的基础上,树立以社会法优先适用的立法理念和司法理念,工伤赔偿采用补充模式不失为一种合理的选择,在最大限度内使劳动者的合法权益真正得到实现.

在我国司法实践中,对于用人单位的原因导致的工伤事故,受害的劳动者只能主张工伤保险待遇,而对于第三人的原因导致的工伤事故,受害的劳动者既能主张工伤保险待遇又能向第三人主张民事赔偿。这种工伤保险与民事赔偿的衔接模式不能体现平等对待每一位劳动者。我国新的工伤保险法律法规规定的先行支付及追偿权为协调工伤保险与民事赔偿的衔接提供了借鉴。在工伤保险与民事赔偿的衔接上,采用＂补充模式＂可以避免受工伤事故伤害的劳动者获得额外的利益,同时应全面规定工伤保险的先行支付义务及对工伤事故的相关责任人员的追偿权,这样可以使相关责任人员承担相应的法律责任,并使劳动者在发生工伤事故后能获得标准统一的赔偿或补偿。
