民族自治地方单行条例的制定与完善

民族自治地方应当依法制定单行条例;单行条例是民族自治地方行使自治权的一种主要法规形式,它只能以自治权限的范围为依据规定相关事项。自治地方单行条例是一项特别的立法授权,是规制地方经济社会发展过程中各种矛盾的有效方式,是民族自治地方民族法制体系建设的重要组成部分。必须完善民族自治地方单行条例的立法决策和程序,建立单行条例实施、适用的法律环境,健全单行条例的立法监督机制,促进自治区单行条例的制定和实施。

单行条例是我国民族自治地方行使自治权的法律依据之一，现行单行条例在立法实践中存在很多缺陷，主要表现在：单行条例立法总量少、立法层次低，立法主体范围窄，具体内容缺少民族特色和地域特点，立法程序不完善等。我们应加强单行条例立法工作，提高立法层次，扩大立法主体的范围，在单行条例中增加自治地方自治民族特点和地域特色，加强单行条例立法程序的科学性和民主性。

基于法律文化学的视角,可以对西南少数民族习惯法作出考察和解读。应用法律多元主义从文化理论层面对西南少数民族习惯法的价值进行论证,而应用"活法"理论则可从文化之实践层面对西南少数民族习惯法的存在原因作出剖析。作为一个庞杂的习惯法系统,西南少数民族习惯法包含着壮族习惯法、苗族习惯法、傣族习惯法、瑶族习惯法等子系统。在我国西南地区,这些少数民族习惯法的命运不但取决于其自身能否实现良性发展,更取决于它能否与"国家法"之间构建起良性互动关系。对于西南少数民族习惯法中的合理内容,民族自治地方应通过自治条例或单行条例的方式予以吸收,而对于其中部分落后内容,"国家法"应予以明确摒弃,唯此方为实现两者良性互动的有效路径。
