国家构建与民主政治基础的确立

国家构建过程就是现代民族国家的形成完善过程,现代民族国家的形成完善则是民主政治发展的前提和基础。西方民主政治建立于现代民族国家建构的基础之上,我国国家权力的民主化也需要民族国家形成的基础。现阶段,我国一些基本国家制度还没有建构好,过分强调国家权力民主化会导致社会政治的不稳定。     

司法权的特点及我国司法体制改革的价值取向

在西方政治理论中，司法权是一项独立的权力，它与立法权、行政权一起构成国家权力。我国虽未在理论上对国家权力进行划分，但依据宪法，司法权的独立存在却是不争的事实。通常认为，司法权与其他国家权力相比有以下几个方面的特点：

在以计划经济为基础的政治形态中，通过体制和组织的力量，形成党、国家和社会“三位一体”政治权力关系。但在改革开放后，社会主义市场经济体制的建立和发展，动摇了党与国家、党与社会关系的传统基础，带来了国家与社会关系的深刻变化。因此，在社会转型期合理调整三者之间的权力关系便成为我国政治发展的一个重要方面。     

论中国式文教国家：基于与西方古今国家形态之宏观历史比较

国家联结人民为一体之主要机制是宗教和政府,宗教作为“铺轨车”所塑造的两者关系,决定国家形态的深层结构。在中国,郡县制政府吸纳孔子文教,形成了文教国家。文教支持政治权力,故政府拥有道德正当性和政治自主性,实现直接统治,构建民众的国民身份认同。沿此历史路径展开的现代国家构建进程,定型于强化版文教国家。在西方,神教贬抑世俗政府,政府缺乏道德正当性与政治自主性,也就缺乏必要的覆盖和穿透力量,故其在古代无法抗衡教会,形成神教统治秩序;进入现代,仍不得不借助神教构建国民,结果形成了自我神圣化的民族和民族国家;教会转化为社会,社会自我神圣化、抗衡政府权力,结果形成了自由主义国家。以直接统治、国民认同两个尺度衡量,中国式文教国家形态优于西方式民族国家和自由主义国家形态。     

西方国家典型性权力监督制约机制比较研究

通过比较的方法对西方国家典型性分权制衡体制进行分析,进而发现,权力监督与制约机制的确立破除了封建君主集权专制制度,有效地遏制了国家权力的滥用,揭露了一些问题并查处了一批大案要案。但也造成了国家机关之间的相互扯皮、互不服从,从而严重影响了权力运行的效率。资本主义国家所建立的权力监督与制约机制本身的分权并不彻底,尤其是立法权对行政权的控制与制约往往力不从心。     

中外政府与高校权力博弈模式比较研究

本文分析了加拿大、美国等西方国家政府与高校权力博弈模式的主要特征,并在此基础上,详细探讨了转型期中国政府与高校权力博弈模式的特点及其演变方式。本文认为,西方国家政府与高校权力博弈模式共有四种,一是高校自治型;二是高校主导型;三是政府主导型;四是政府专制型。其中,高校自治型主要出现于欧洲中世纪中晚期,而政府专制型只在19世纪后期以来才在个别国家出现,目前大多数西方国家都是实行高校主导型或政府主导型。从新中国成立到1992年,中国政府与高校权力博弈模式均为政府专制型,此后才逐步演化为政府主导型。最后,笔者还提出了构建新型政府与高校权力博弈模式的设想。
