天平,运用其衡量功能协调利益关系;宝剑,代表正义的斗争。本文从＂衡量＂这一角度分析天平的功能,从＂斗争＂这一角度论述利用宝剑去主张和维护权利,从而维护法律的必要性,以及天平与宝剑并存的重要性。     

儿童权利意识的本体价值与培养理念

儿童权利的实现和维护固然有赖于成人社会的努力,但就儿童自身而言,作为一个权利主体,主体权利意识的觉醒必然是维护儿童权利的重要内部力量。儿童权利意识是儿童对自我利益和自由的认知,以及对他人主张、要求和维护权利的行为及观点的社会评价。一定程度的权利意识有助于维护儿童个人权利,有助于促进健康人格的形成,有利于促进个体创造性的发展。进行权利意识培养应树立四种理念:从权利救助到权利意识培养与权利救助并重;从外界维护到儿童自护与外界维护并重;从"规训式"教育到儿童主体性教育;从法制教育到公民意识教育。

权利冲突在实践中是大量存在的,本文主要从分析权利和权利冲突的实质入手,阐明权利冲突在本质上是一种利益的冲突,认为解决冲突的途径有二：立法和利益衡量。而由于立法的滞后性和宏观性。难以对发生的每一权利冲突做出规定,因而很多时候要依靠利益衡量的方法做出判断。

权利意识是指公民对自己作为独立主体的利益和自由的认识、主张和要求,以及对他人同样的认识、主张和要求的社会评价。即权利意识不仅包括对自身权利的认识、主张,还包括对他人权利的评价。     

经济分析方法与司法中的利益衡量

目前中国法学界关于利益衡量理论的研究非常混乱。我们认为,利益衡量是法官在司法过程中运用的、适用于规范之间冲突的一种法律方法。利益衡量面临的困境是,其主张者并没有找到行之有效的进行利益衡量的标准。法的经济分析利用相关的经济学原理来分析法律问题,即对法律问题进行定量分析,来追求效益的最大化。从经济分析的角度,法官进行的利益衡量实际上也是一个对成本与收益进行比较论证的过程。因此,经济分析工具是利益衡量的有效标尺。但是,运用经济分析方法进行利益衡量并非无懈可击,其存在着不可避免的局限性。     

论权利与惩罚——基于镶嵌视角的分析

权利本身包含了对惩罚的依赖,只有在利益、主张、资格受到损害时,能够通过惩罚来维护、恢复受损状态,才能够界定出权利.而惩罚本身并不总是有效,一个有效的惩罚依赖于镶嵌结构,只有当个体、群体具有高度协调的一致性,才能保证惩罚的有效.因此,权利的实现和维护在根本层面上依赖一个有机协调的社会秩序,只有这样,整个社会的权利量才能够得到最优化.

一、家长教育权利的内涵与意义 家长教育权利应具有以下四个要素:(1)家长教育权利主体通过权利主张应该得到某种利益,能否实际获得利益或利益大小将直接影响主体行使权利的积极性.(2)家长教育权利主体可以根据法律规定,要求权利相对方为其提供一定条件,并有在其权利受到侵害时申请救济的要求权,或称教育主张权.
