论强制医疗执行的检察监督

为了强化对强制医疗执行的监督,修改后的《人民检察院刑事诉讼规则（试行）》将该项职责赋予了人民检察院监所检察部门。权力制约理论、权利救济理论和监所检察理论是强制医疗执行检察监督的法理基础。监所检察部门应重点加强对强制医疗交付、执行和解除的检察监督,以派驻检察或巡回检察、同步执行监督、提出纠正意见和检察建议为途径开展该项工作,并通过制定专门法规、构建协作机制、强化能力建设进一步加以完善。     

论精神病人强制医疗程序的法律监督

2012年刑事诉讼法正式确立了依法不负刑事责任的精神病人强制医疗程序,并规定由人民检察院对该程序的决定和执行实行监督.人民检察院在监督强制医疗程序的过程中,会遇到诸多的困难和问题.检察机关应当遵循人权尊重与保障、权力与职责相统一、依法监督与工作协调相结合三项原则,在法律监督立法不断完善的基础上,加强保障机制的建设,从而促进强制医疗程序的良好实施.     

民事再审检察建议的立法问题与修正建议

针对现实中再审检察建议存在法律效力效力缺失以及该制度实际操作中程序不规范问题,试提出修正再审检察建议的建议。在适用中加强与抗诉的协调与互补;树立起民事、行政检察监督以抗诉为主,以再审检察建议为补充的理念;民事再审检察建议应经立案、阅卷、调查、集体讨论、主管检察长或检察长决定等一整套严密的程序后才可形成;以再审检察建议回复制度为切入点加强再审检察建议的法律效力;增强再审检察建议内容的针对性与说理性,从而实现民事再审检察建议的制度化、正规化、规范化。     

刑罚变更执行同步监督研究

刑罚变更执行监督是检察机关的一项重要职责。检察机关对刑罚变更执行活动进行同步监督,就是要对刑罚变更的实体和程序进行包括事前监督、事中监督、事后监督的全过程监督,这是检察监督的应然结论。近年来,地方各级检察机关纷纷开展刑罚变更执行同步监督工作,在取得较好成效的同时也反映出一些问题,如立法和司法不完善、制度机制不健全、检察机关自身建设不到位等。因此,要有效开展刑罚变更执行同步监督工作,还需要完善同步监督的立法和司法,健全刑罚执行的同步监督机制,健全暂予监外执行的同步监督机制,强化检察机关法律监督的效力机制,加强检察机关自身建设。     

社区矫正检察监督存在的问题及对策

社区矫正是与监禁矫正并行的行刑方式,将其纳入检察机关的监督范围有充足的理论基础。但现阶段人民检察院参与社区矫正工作存在监督对象模糊、监督效力乏力等问题,应在现有的实际情况的基础上,理论联系实际,具有前瞻性地对检察监督进行制度化、规范化建设,才能增强检察监督的实际效果。

检察建议无疑是检察机关法律监督的重要形式之一,但检察建议自身面临着法律依据不足、法律效力不强、法律程序不明等现实问题,面对这些问题如何立足于现有的法律制度框架,最大限度的发挥检察建议的效力,实现检察机关法律监督的职能定位,成为本文研究的重点。     

基层民事检察监督路径的修法建议

民事检察监督的路径问题成为当前民事诉讼法修改的热点之一。现行民事诉讼法确立的上级检察机关通过抗诉强制启动再审程序的民事检察监督模式决定了基层检察院缺乏开展民事检察监督的法定依据。然而检察机关在我国宪政体系中的职责和司法现实需要将基层民事检察监督路径问题逐步推至公众关注的视野。基于尊重当事人权利、尊重法院独立审判以及化解矛盾、维护和谐的原则,基层检察机关对第一审程序、生效裁判文书、民事执行活动以及解纷息诉方面均可以适当方式开展监督工作。     

纠正意见实效性问题研究——从刑事司法角度进行分析

纠正意见是检察机关开展法律监督的重要手段之一。但现实规则中纠正意见的落实方式具有协商性和建议性特征,使得实践中纠正意见的实效程度堪忧,有强化纠正意见实效性的必要。强制性是检察监督权力属性的应有之意,纠正意见的程序效力是诉讼行为规律之必然反映,增强纠正意见的实效性是提高检察监督实效性的必然要求。应当从明确法律地位,规范适用程序、完善保障机制等方面入手,提高纠正意见检察监督方式的实效性。     

我国刑事审判监督问题探析

我国检察院刑事审判监督普遍薄弱,庭审监督虚无,庭外调查和庭外程序监督缺乏,庭前请示无法监督,简易程序和自诉案件的监督空白.原因在于法律规定的不具体,监督形式简单,检察院没有强制监督权.因此,赋予检察院强制监督权、强制抗诉权,是确保检察监督权有效履行的重要举措.     

论我国强制医疗制度之完善

《刑事诉讼法》修正案以及《精神卫生法》的出台使我国精神病患者强制医疗制度有了质的进步。然而,由于立法与司法实践的脱节以及不同法律文本之间规定的冲突和矛盾,我国强制医疗制度仍存在诸多问题。譬如,在实体上,强制医疗制度存在着性质尚不明确、适用对象范围过窄、公安机关采取的临时保护性约束措施缺乏具体的程序规定、以及检察机关的监督方式缺乏规定等不足之处;在程序上,强制医疗制度存在着强制医疗程序与已启动的刑事诉讼程序的关系衔接不明、审判程序不明确以及强制医疗的期间缺乏规定等缺陷。为了更好的保障该制度的实施,有必要从程序和实体这两个方面进一步完善我国的强制医疗制度。
