论律师提前介入法律援助申请

自“人权入宪”后,以人为本的执政理念逐步深化,为进一步提高法律援助工作的效率和服务质量,达到“应援尽援”的工作目标,很多人建议执业律师在受理、审查法律援助申请中提前介入,认为这样做有利于拓展法律援助的受案渠道,方便公民申请法律援助,并能在一定程度上调动律师的积极性,提高援助案件的办案质量。但同时,这种做法似乎又与法律援助现行规定相冲突,为此,有必要就律师提前介入法律援助申请的问题展开深入研究。     

论律师在刑事诉讼中的调查取证权

虽然我国刑事诉讼法赋予了律师在侦查阶段提前介入的权利，但由于现行法律规定及司法实践习惯的约束，律师的调查取证权受到了种种限制，因此不利于律师很好地履行辩护人的职责。必须改革现行的证据制度，以保障律师在刑事诉讼中的调查取证权的实现。

我国现行刑事诉讼法将律师介入刑事诉讼活动的时间从过去的审判阶段提前到侦查阶段,从而使律师参与刑事诉讼活动的时间与国际上通行的作法相一致,标志着我国刑事诉讼法律制度日趋完善。但是,纵观现行刑事诉讼法对律师提前介入刑事诉讼活动的有关规定,可以看出,它有着不尽人意之处,还需要一个发展完善的过程。     

保障侦查阶段律师会见权的法律思考

修改后的刑事诉讼法允许律师在侦查阶段介入刑事诉讼并赋予律师与犯罪嫌疑人会见权，这在刑事诉讼中具有非常重要的意义。然而，由于立法的不完善以及执法中存在的问题，律师的会见权在司法实践中往往难以实现。对此，笔者认为，完善相关法律规定，转变执法人员观念、提高执法人员素质并加强律师自身的维权意识是保障律师会见权得以充分实现的关键。
