"法制"与"法治"辨析

法制与法治有区别又有联系，本文通过“法制”与“法治”的辩析，旨在阐明中国共产党在新时期“依法治国”思想的又一次飞跃。     

"为民作主"与"人民自己作主"--我国依法治国的理念基础思考

“为民作主”与“人民自己作主”所蕴涵的法治理念基础有本质的不同。法制理念的确立是我国依法治国方略的关键。当前，必须结合中国国情，实现“为民作主”向依法行政转化；培养公民的法律信仰和权利意识，由“为民作主”向“人民自己作主”过渡。     

法家"法治"与现代法治之比较

法家“法治”主张用“严刑酷罚”来统治社会，现代法治与其有着本质的区别，具有特定的全新的内涵。法家“法治”是维护封建统治阶级专制统治的工具，其目的在于维护权力，现代法治与民主紧密相联，目的在于保障权利，在罪与刑，法与德方面二者也有重要的区别。     

"人权原则"和"民主原则"对国际关系准则的挑战

冷战结束后,美国等西方国家将“人权原则”、“民主原则”等国内政治原则运用在国际关系中,严重挑战国家主权原则、主权平等原则、不干涉内政原则和和平解决国际争端原则。美国等国以“人权原则”为理论盾牌进行的“人道主义干预”,造成了新的人道主义灾难,其以自己的“民主模式”改造他国的行为,则是与国际关系民主化背道而驰的。在经济全球化深入发展的背景下,各国的相互依存加深,同时实力原则和强权政治仍在起作用。应认清国家主权原则和国际关系民主化所面临的挑战,以避免“人权原则”和“民主原则”成为推行霸权主义政策国家干涉别国内政的借口。     

全面确立直接、言词原则

直接，言词原则是现代法制国家普遍遵守的刑事诉讼原则，它蕴含了民主与进步。在我国刑事审判程序中全面确立直接言词原则是一项复杂的系统工程，没有一种保障审判程序自治性的环境和条件，这一原则就很难在司法实践中得到切实贯彻，因此，全面确立直接言词原则必然伴随着一系列司法制度和程度的改革与完善。     

侵权法原则初探

侵权法原则的确立，是侵权法体系完善的需要，也是法治社会权利保障的需要。侵权法原则体现着侵权法的本质和根本价值。侵权法应确立其五大原则：权利保障原则、侵权法定原则、责任公平原则、救济合理原则及利益衡平原则。只有这样，才能够进一步完善侵权法学科体系，充分发挥侵权法保障权利、实现社会正义的价值和功能。     

浅谈"法治"

在中国建立法治国家“以法冶国”，必须坚持法治的三个基本原则即要有良好的法，普遍地依从法，有确保国家守法的权力机制，这样才能达到法治的目的。     

历史视阈中的先秦"德刑之辩"及其现代观照

在我国先秦时期，以周公“敬德保民”、孔子“德政”、孟子“民本”、荀子“隆礼重法”为代表的儒家德治理论和以管仲“法制”、子产“铸刑书”、商鞅“严刑峻法”、韩非子“重法轻德”为代表的法家法治理论相互辩诘。两学派在治国的哲学基础和方法论上存在根本分歧，但在其“人治”本质上又是一致的。借鉴先秦“德刑之辩”的历史经验，一方面要充分认识到我国与西方法治的差距，我国推行法治任重道远，另一方面要坚持德法并举，相得益彰。     

试论中国"入世"对行政审判的挑战与对策

中国入世迫切要求中国的法制与国际规则接轨，行政审判面临的外部形势严峻。处理国际条约与国内法规的原则为国际条约与国内立法表现为同等法律效力，而当其与国内法发生相冲突时，修改本国法律，从而使之相一致。章认为应正视行政审判面临的挑战。解放思想，抓住机遇，接受挑战。必须以宪法为原则，重新确立行政审判的位置。努力营造行政诉讼的氛围。强化入世观念，加强行政审判。强化公正高效的观念，实行高效的行政审判。     

从"顺民"到"主人"
