“言意之辨”与中国传统哲学

“道”是中国传统哲学的最高本体，也是通过主体的心性修养所达到的一种状态或境界。“道”不是实体，不可言说，不可分析，只能诉诸于主体的心性直觉。通过对“道”的直觉思维来把握和表达人的超越性理想和形上追求，是中国传统哲学通往形上境界的特有门径和思维特质，而这种思维特质的形成，正与肇端于先秦时期的“言意之辨”有着深刻的关联。可以说“言意之辨”既是这种超越而内在的直觉思维形成的深层原因，也是其成为传统和特质的内在根据。

在中国传统社会中，士人作为文化的载体，以“道”自守，在社会中占据了重要地位。由于“道”往往是无形的，能否恪守“道”从根本上说还在于士人是否有自觉意识。当“道”和“势”处于一种紧张的对峙状态时，士人也就面临着三种选择，即以“道”抗“势”、无道则隐和弃“道”求荣。

"伦理法"概念之辨析

“伦理法”是相对于中国传统法文化而言的,即中国传统法文化的特质为“伦理法”。但“伦理法”的概括,并不意味着中国传统法文化的外延与伦理的外延全部重叠,而是就其总体精神而言,中国古代法受着伦理道德的支配,从而成为伦理的附属物。其主要表现为：立法的道德化、司法的道德化、实现法律价值取向的道德化。

中国的传统教育以追求“道”为最高目的。而“道”的内容主要是“仁义礼智信孝廉”,十三经除了《尔雅》外,都是讲“道”的,故求“道”必须讲经、学经。厚厚的十三经,不知白了多少少年头,耗尽了多少聪明人的心和智,然而“道”是什么？“道”在哪里？仍然是一头雾水。求“道”而不知“道”、不得“道”,是中国旧知识分子的人生悲剧,也是中国传统教育（私塾）的悲剧。道在哪里？道在脚下,道在心里。道是实践的,也是理性的。没有实践的“道”是虚“道”,是假“道”,没有理性的“道”。是盲“道”,是幻“道”。实践与理性的结合,才是真实的可行的“道”。
