刑法规范是规定犯罪及其责任的法规范。刑法规范既是行为规范，又是责任规范；既是禁止规范，又是命令规范；既是假设规范，又是评价规范；既是制裁规范，又是裁判规范。刑法规范的机能不同于刑法机能，它包括评价机能和决定机能，是评价机能和决定机能的有机统一。

行政处罚与刑事处罚立足于法治国原则之下,不仅共享着类似的公法性质与限权苛责功能,也在实体规范层面有着较多的耦合.首先,就二者属性而言,行政处罚法与刑法同属公法性质,着重发挥公权对私权的限制作用.其次,从法律后果来看,行政处罚法与刑法均将决定违法行为人应承担何种类型、何种程度的不利后果.再次,就法律功能而言,刑事处罚条款与行政处罚条款之功能均在于凭借制裁手段的威慑力量,确保其他法律规范中所设定的权利义务模型能够转化为理想的社会生活秩序,并对不适法的状态予以纠正与制止.然后,从规范效应来看,纵现各部行政法律规范,其在设立行政责任时往往附有刑事责任的条款;而细察刑法规范也可明见,很多犯罪构成往往从属于或依赖于行政上的违法.最后,从刑事处罚与行政处罚在现行法律中已经共享了些许相同或近似的原则.如罪刑法定原则、罪刑相适应原则、正当程序原则、一事不再罚等.因此,行政处罚与刑事处罚不仅在理论层面存在若干相似之处,即便是规范实践中亦存在吻合的地方.这一系列的巧合就暗示着刑罚中的其它理论亦当可扩张适用于行政处罚论域之中.具体而言,刑罚理论中的期待可能性理论、二元的不法理论以及上诉不加刑原则应当在未来的行政处罚理论构建中有着一席之地.
