版权再造:IP开发的三种模式

“IP”即版权.好莱坞的版权概念更注重对原创作品的“保护”,而国内兴起的IP概念则更强调对原创作品的“开发”.基于水平整合的现代娱乐业结构设计理念,文章提出围绕版权价值挖掘,先后出现和并存着三种IP开发模式:产品扩展模式、项目协同模式和众创模式.对应Ip被视作产品、项目和众创过程,IP开发从无核心到有核心最终到去核心,涵盖了行动、环境与当代神话.

孤儿作品版权保护的三大模式评析

随着数字化和网络化的快速发展,孤儿作品的保护和使用已成为版权界关注的热点问题.为寻求解决方案,许多国家在立法和司法活动中进行了大量的探索和实践.就孤儿作品的保护和使用,现已形成扩展性集体授权、非自愿许可和责任限制三种主要模式.这三种模式在孤儿作品的认定、合理使用和权利救济等方面做出不同程度的规定,对完善我国孤儿作品的版权保护颇具启发意义.     

The Battle of the Downs

The first newspaper publishers of the seventeenth century faced a momentous challenge. How could they compete in a highly competitive news market with their periodical invention? The newspaper was generally a cautious medium, offering an assortment of short international news reports without overarching editorial opinion. The newspaper rarely displayed the wit and polemic present in other news media of the early modern period, and operated with a rigid schedule of publication. This article portrays how such standards could be cast off in the face of military victory and defeat. The naval battle of the Downs in 1639 engaged two rival newspaper markets in Amsterdam and Antwerp. By analysing the simultaneous reporting of the battle in the Dutch Republic and the Habsburg Netherlands it becomes clear that newspaper publishers employed numerous tactics in order to shape the coverage of the battle—and to strive for the relevance of their newspapers.

The Battle of 42nd Street

This essay discusses the New York Public Library’s (NYPL)’s unique importance and chronicles the history and execution of the NYPL plan to remodel the Stephen A. Schwarzman Building on 42nd Street (also known as the Central Library). The plan would have sent millions of books to a storage facility in New Jersey and resulted in the sale of several NYPL branches to finance the remodeling of the building on 42nd Street. Not surprisingly these plans were greeted with alarm and galvanized efforts of librarians, citizens, bookworms, activists, and writers to halt the Central Library Plan. The essay concludes with some thoughts about the importance of transparency in the public library milieu.     

The history of the Arabic-Islamic Libraries: 7th to 14th Centuries

This historical study deals with the development of the Arabic-Islamic libraries in the 7–14th Century. It discusses the factors that lead to the rising of the different types of libraries which are: mosques, private, public and academic libraries. The study gives, in some detail, information about the most famous libraries in the Arabic-Islamic civilization. It also talks about management and organization of these libraries. Finally, the study discusses the factors behind the destruction of the Arabic-Islamic libraries.     

世纪之交的参考咨询工作

我们所处的时代,是一个信息化的时代.社会发展的趋势,就是信息社会化,社会信息化,而图书馆则被看作是重要的文献信息中心.在这世纪之交,如何发挥图书馆信息中心的作用,满足社会各方面的需要,进而得到公众的承认并改变图书馆被冷落的困难状况,笔者认为:进一步深入开展参考咨询工作是其重要的,有效的途径之一.为此,笔者拟从省会市级公共图书馆的角度,对参考咨询工作进行一些探讨.

The Economic Logic of Copyright

Summary

Current efforts in Congress to strengthen the copyright protection afforded databases should seriously concern all librarians but especially those in legal reference. The reliance on databases, primarily those of Lexis-Nexis and Westlaw, make the users of such services particularly vulnerable to the exercise of monopoly power that copyright grants. An understanding of the unique economic characteristics of “information” and its relation to the public domain is essential to evaluating the economic, let alone social-democratic, impact of current proposals. This paper argues “economic logic” in and of itself does not necessarily support the provision of stronger copyright in general and for databases in particular.     

基于版权保护的日本著作权法修正案的出台

随着基于互联网传播的新媒体在全球范围内的日益发展,数字出版成为全球出版行业发展的重头戏.在数字出版蓬勃发展的背景下,出版物盗版现象猖獗、著作者权利受到侵害等问题使得出版行业遭受损失.经过法律界、出版界专家学者等多方面的提案,日本国会通过了“增设数字出版权”为核心内容的《日本著作权法修正案》(以下简称《修正案》),并于2015年正式实施.文章通过梳理《修正案》的出台过程,分析修订的主要方案和主要分歧点,比较修订前后著作权法相关内容的变化,总结著作权法修订的法律意义和媒介发展层面的意义,从而为我国数字出版版权保护工作提供可借鉴的经验与启示.

图书馆网站版权政策是图书馆尊重版权人知识产权的表态,也是图书馆工作者和读者规避版权风险的行为指南。美国三大国家图书馆网站的版权政策涉及政策法源、版权人权利确认、合理使用、免责条款、侵权形式、图书馆业务说明、承诺以及网站安全等内容,体现出专业化和人性化的服务精神,具有很多可取之处,也存在一些不足,对我国图书馆网站版权政策的改善具有一定的借鉴意义。     

The Imperial Russian Revision Lists of the Eighteenth and Nineteenth Centuries

ABSTRACT

One of the most important resources for social and family historians researching the former Russian Empire are the revision lists, a series of ten enumerations of the population conducted between 1719 and 1858. Listing the members of each household among taxable classes of people across the Russian Empire, the revision lists are useful for studying historical population demographics and reconstructing family relationships. An awareness of these records and where to access them can be useful for Slavic librarians to facilitate the research of Russian historians and genealogists. This article provides an overview of the history and content of the revision lists with a survey of available collections online and offline.
