城镇化进程中的失地农民保障问题

近年来,随着工业化和城市化进程的加快,大量的农村集体土地被征用,失地农民越来越多。在农地征用过程中,由于现有土地制度存在缺陷、土地征用程序不规范、土地征用补偿标准测算办法不够科学合理及土地市场机制不完善,导致失地农民就业难、收入水平下降、失去社会保障,影响社会稳定。解决失地农民的保障问题,必须加强管理,严格控制征地;完善征地程序;建立合理的征地补偿和利益分享机制;广开渠道促进失地农民就业;建立失地农民社会保障制度;为失地农民提供法律援助。     

失地农民“可持续生计”问题系统性解决方案探析

土地是农民赖以生存和发展的生产资料和基本条件,对农民而言,土地具有三种基本的社会功能:即提供就业岗位、获取经济收益、基本生活保障。伴随着我国工业化、城镇化进程的加快,越来越多的农民失去土地成为必然。尽管各地政府在征地过程中采取了多种政策措施来保障失地农民的基本权益,但由于缺乏系统性的解决方案,许多失地农民"可持续生计"仍无保障,由此产生了诸如征地补偿标准低、补偿安置不完善、再就业难、社会保障不健全等失地农民问题。由此,立足于失地农民"可持续生计"考虑,建议政府政策思路重点放在土地的"功能性替代"上,通过制定合理的补偿和增收机制、构建再就业机制、完善社会保障机制等系统性方案设计,最终有效解决失地农民的长远生计问题。     

农民土地征迁安置工作研究——基于马鞍山市调研分析

在城市化进程中,需要征用大量原农业用地,部分地方政府在征地过程中,侵害失地农民利益,且征地后安置工作不合理,农民失地后易陷入失业困境,生活失去出路。本文通过马鞍山市征地拆迁调研,分析了地方政府在土地征迁安置工作中与失地农民之间产生矛盾的原因,提出通过政府途径、就业安置及土地流转等方式缓解征迁安置过程中的矛盾。     

建立失地农民就业和长效保障机制——安庆市失地农民调查与补偿模式研究

现行补偿模式对失地农民的补偿严重偏低,不足以解决他们失去土地后的隐性失业和对未来生活的担忧。构建失地农民就业和长效保障机制:提高补贴标准;建立政府征地调节基金,解决补偿标准不一问题;设立政府主导的就业扶持基金;建立失地农民养老保障机制,解决他们的后顾之忧。     

贵州水电开发中失地农民社会保障问题研究

在贵州水电开发中，征用农民的土地，大量农民变成失地农民，现行的征地安置标准过低并且方式单一，导致大量失地农民转化为无业贫民，其结果必然会影响到社会的安定。要建设贵州新农村，构建和谐社会，建立失地农民的生活保障制度具有现实意义。本文通过对贵州地区水电建设中失地农民的生活现状，征地补偿情况以及社会保障等情况进行实地调查研究，为失地农民自我发展和生活保障提供对策。     

关于征地补偿纠纷的调查报告——基于武汉市、鹤壁市的调查

对武汉、鹤壁两市村庄进行调查,发现存在着大量的征地补偿纠纷,而现存的征地补偿纠纷解决机制却没有发挥应有的作用,这主要是由于制度层面的某些缺陷和失地农民深受传统意识的影响而存在认识上的偏差造成的。建议在澄清征地补偿过程中不同争议的性质的基础上,构建以行政程序、司法程序救济为主,多元化救济途径并存的体系,并积极促进失地农民传统意识的转变。     

关于失地农民养老保障问题的思考

长期以来,土地保障一直是我国农民养老保障的传统模式,当前我国失地农民养老保障面临着征地补偿费用过低的问题,同时现行的失地农民养老保险模式与城镇职工养老保障模式差距巨大,由政府直接经营失地农民养老保险也存在着诸多弊端。应建立明晰的产权制度,从源头上解决失地补偿费过低的问题,还应借鉴别国经验创立与我国国情相适应的商业保险模式,解决失地农民养老保障问题。     

农地征收制度存在的主要问题及其对策

伴随我国城市化进程加快,农地征收规模膨胀,因征地性质模糊、"公共利益"范围泛化、补偿机制落后、被征地农民话语权缺失又缺乏权利救济机制等,征地引发的社会矛盾有激化趋势。针对这一问题,提出对策:严格界定"公共利益",探索非公益性用地制度;确认土地发展权,坚持完全补偿原则;完善土地征收制度和程序,保障征地过程中的农民话语权;建立健全征地补偿机制,长久保障失地农民基本生活;制定《土地征收法》,切实为征地提供从征收到救济的全套法律依据。     

土地征收中公共利益与个人利益关系刍议

正确处理土地征收中公共利益与个人利益的关系是促进国家经济建设、维护农民合法权益、保证社会安定与和谐发展的重要基础。在土地征收中,公共利益与个人利益二者之间的矛盾主要表现为征地范围过宽、补偿偏低、安置不当,其原因为“公共利益”界定不明、集体土地产权缺陷、政府权力寻租和政府行为缺乏规范。正确处理二者关系应从严格界定公共利益、完善集体土地产权制度、完善征地补偿机制和妥善安置失地农民着手。

在对滁州市城镇化进程中失地农民补偿实践分析的基础上,指出征地补偿过程中存在程序不规范、标准偏低、增值收益分配不合理、社会保障不完善等问题,提出改善失地农民补偿问题的措施。

The Reader Response Approach to Teaching of English Literature

During interview with English majors, it was found that a majority of students expressed disappointment with their experience of English literature classes. Students' dislike of learning English literature appears to be the major problem of teaching English literature in China. Reader response approach is a good way to solve this problem. In this paper, I explain the rationale behind the reader response approach, such as its origin, definition, features, assumptions, and strategies. Then I illustrate how reader response approach works as a teaching strategy by presenting several teaching models. At last I evaluate its usefuiness for teachers and present the advantages of reader response approach in Chinese context.
