论我国刑事不起诉制约制度的完善

检察机关的刑事不起诉,对于节约司法资源、减轻人民法院审理压力等方面有着积极的意义,但不起诉行为的不当使用又会破坏法制、放纵犯罪,所以实践中对其进行制约是很有必要的。与国外较为成熟的不起诉制约机制相比较,我国建立了具有中国特色的刑事不起诉制约机制,但不完善,特别是在人民法院的作用、被害人的自诉条件及不起诉善后事宜的处置等方面需要进一步的探索。
