在我国 ,设立行政公诉制度对实现行政法治具有重大意义 ,主要应从确立行政公诉原告资格、明确规定行政公诉的受案范围和确定行政公诉案件的审级制度几个方面来具体构造我国的行政公诉制度

行政公诉制度是为了保障公共利益不受损害,由代表公共利益的国家机关针对行政机关侵害公共利益的违法行为提起诉讼的制度.本文参照国外的行政公诉制度并结合中国的具体实践,指出在中国未来设计行政公诉程序时,所要注意的原告的资格、受案范围、管辖、举证责任、诉讼费用等问题.
