我国图书馆为特别适用主体的技术措施规避例外规则构建研究

为更好维持版权人和社会公众的利益平衡,许多国家专门设置图书馆等机构可适用的技术措施规避例外条款,其主要立法模式可分欧盟、美国、日本和新西兰四种模式,这四种模式中图书馆享有的规避技术措施权限范围具有较大差异性。我国并没有专门规定以图书馆为特别适用主体的技术措施规避例外情形,相关立法面临技术措施保护水平过高、技术措施例外规定不足以及缺乏应对技术措施滥用的机制的现状。我国图书馆可适用的技术措施规避例外应从以下三个维度进行构建：扩大图书馆为特别适用主体的技术措施规避例外的制度空间、规范图书馆等间接规避技术措施例外的适用条件以及完善图书馆等机构技术措施规避例外的配套机制。     

适用于图书馆的技术措施规避例外在国外图书馆的应用剖析

在剖析当前美国、澳大利亚和南非等国家有关图书馆可适用的技术措施规避例外并不能满足图书馆业务发展的需要的基础上,针对是否应该要求立法调整当前有关技术措施规避的例外规定,以保证图书馆可以顺畅从事著作权法赋予图书馆可以从事的各项活动,同时就美国著作权法第108条款研究组提出的解决方案加以评析,指出技术措施是继著作权法律、许可协议之后为版权拥有者提供的第三种保护手段,认为从利益平衡的角度考虑,须根据实践需要动态地调整可适用于图书馆的技术措施规避例外。     

我国图书馆规避著作权侵权风险的对策建议——基于图书馆可适用的著作权例外

从法定的可适用于图书馆的著作权例外、从图书馆面临的数字化网络化环境和从图书馆当前的资源建设与信息服务等三个角度,分析从图书馆可适用的著作权例外角度规避著作权侵权风险的可行性。在此基础上,将我国图书馆规避著作权侵权风险的对策建议分为两大方面。一是严格遵循并充分利用可适用于图书馆的著作权例外,包括:图书馆从复制权例外角度开展数字资源长期保存的对策;图书馆从信息网络传播权例外角度规避著作权侵权风险的对策;图书馆从技术措施规避例外角度规避著作权侵权风险的对策;充分利用可适用于图书馆的声明性著作权例外的对策。二是不作被动地等待,而是主动参与、积极宣传和专门跟踪。包括:积极反映著作权例外立法诉求,参与立法活动;加强可适用于图书馆的著作权例外的宣传推广;设置著作权研究部门或专职研究岗位。

防范和化解侵权责任风险是图书馆制作与传播有声书必须高度重视的法律问题之一。立法不健全对图书馆开展有声书版权管理构成了制约,而有声书的版权链条较长、涉及的权利主体众多、授权环节冗杂和用户易于侵权等问题,同样给图书馆规避侵权责任风险带来了困难。本文通过对我国立法现状的介绍和典型有声书版权案件的诉由与审判要点的分析,有利于图书馆明晰引发直接侵权和间接侵权的原因,正确理解归责原则和法律法规的适用条件,从而助力图书馆针对履行法律义务、完善授权模式、约束用户行为等关键问题采取更有效的侵权风险规避策略,不断提高图书馆科学治理版权的水平。     

以立法形式确立对农村图书馆的扶持发展

本文就发展农村图书馆的重要性与必要性，提出了在图书馆立法中以立法的形式确立农村图书馆的优先发展地位，并就农村图书馆立法方面的经费来源、组织机构、人员编制与待遇和运作机制等提出了若干建议。     

Public library outreach as a function of staffing and metropolitan location

Library literature suggests that staffing and metropolitan status may affect a public library's provision of outreach efforts. Data from a 1999 survey of Arizona public library service outlets do not support the role of metropolitan status in outreach provision but reaffirms the role of staffing. In this dataset, Arizona public library service outlets had ongoing outreach efforts, with schools and preschools being the most popular venue for providing those services. Analyzing outlets' provision of outreach as a function of staffing revealed that there is a positive relationship between the number of librarians on staff and the odds that a library would conduct outreach. While metropolitan libraries were also associated with an increase in the odds of conducting outreach and making school visits, this was assumed to be a spurious correlation due to the lack of significance in models accounting for staff and metropolitan status.     

The automation of academic and special libraries in Nigeria: the state of the art

The paper examines the state of library automation in academic and special libraries in Nigeria. As a background, an attempt was made to present efforts made by different bodies and institutions in the country to automate their entire library systems. Also disclosed are the reasons why the libraries opted for automated systems, the successes achieved by some of the libraries in automating their systems, and the problems faced by the libraries who succeeded in automating some of their systems as well as those who are still in the process of doing so. Considering the fact that the automation of library systems in Nigeria has spread from academic and special libraries to the public, and there are also a number of companies/institutions engaged in the provision and servicing of computer hardware and software including management information systems, the paper concluded that the future of library automation in the country is bright.
