国家考试舞弊的刑法规制研究

严重的国家考试舞弊行为应当入罪。在罪名上,可设立独立的国家考试舞弊罪,主要对考生以外的人进行处罚。在犯罪构成上,此罪客体为复杂客体,其行为表现为组织、帮助、实行,其主观罪错是直接故意,其主体包括自然人和单位。在犯罪形态上,应当将此类犯罪规定为情节犯,并明确其与相关犯罪的界限与联系。     

犯罪化与犯罪概念关系之辨证

犯罪化又被称为入罪化,是指将不是犯罪的行为在法律上作为犯罪,使其成为刑事制裁的对象.所以,何种行为能够入罪,也就是犯罪化的标准问题就成为犯罪化的核心,而犯罪化的标准就是指犯罪概念如何界定.犯罪化与犯罪概念关系密切,犯罪概念的界定决定着犯罪圈的大小,实质的犯罪概念对于犯罪化具有前提性的作用,犯罪概念的相对性和绝对性对于刑事立法犯罪化具有指导功能.     

中外脱逃罪立法体例及保护客体比较研究

脱逃罪作为侵犯国家司法权的一类犯罪，在中外刑事立法上存在立法体例上的重大差别。对各国立法体例做出比较，了解和把握各国的立法体例的不同及其原因，对于完善我国脱逃罪的立法具有重要意义。各国立法体例的不同，反映出各国刑法对该罪的保护客体的基本态度。但从对国家司法权的完整保护的视角看，脱逃罪的保护客体应当是国家的拘禁作用。     

论洗钱罪的犯罪构成

根据现行立法,洗钱罪的主要客体要件应该是国家金融秩序,次要客体要件是司法秩序。由此出发,只有既＂侵害国家的金融秩序＂,又侵害司法秩序的的洗钱行为,才是洗钱罪的洗钱行为;为了保持现行立法的协调性,未来的立法修改可把＂狭义的洗钱罪＂、＂窝藏、转移、隐瞒毒品、毒脏罪＂、＂掩饰、隐瞒犯罪所得、犯罪所得收益罪＂合并为＂掩饰、隐瞒犯罪所得、犯罪所得收益罪＂。     

论我国危险驾驶罪的改革与完善

《中华人民共和国刑法修正案(九)》拓展了危险驾驶罪的犯罪主体、行为类型,完善了危险驾驶罪共同犯罪的规定.但仍存在危险驾驶罪犯罪客观方面不完整,刑罚配置不合理,入罪标准不明确等不足,应当修改立法,出台司法解释,扩展犯罪行为类型,完善刑罚体系,细化入罪标准.     

试析性贿赂入罪的必要性及其立法建议

性贿赂犯罪成为新兴贿赂犯罪形态,其具有严重的社会危害性,同其他物质形态贿赂行为一样,性贿赂侵犯的客体都是国家工作人员的廉洁性。然而我国现有惩治贿赂犯罪以"物质利益"为主,对包括性贿赂在内的其他贿赂刑事无法涵盖。为了完善司法体系,打击性贿赂行为,应扩大贿赂犯罪的范围,将性贿赂犯罪化。通过探讨性贿赂入罪的三种观点,从而得出性贿赂入罪的合理性以及相关制度设计。     

英美刑法中的共谋罪及其借鉴

英美国家共谋罪立法有其合理的立法基础,争议的存在并没有妨碍其成为法定的犯罪。共谋罪成立的核心是共谋协议,其实质在于惩处协议者之间为推进犯罪而达成的有形或无形的不法合意。共谋协议中并不需要知道同伙的身份以及合伙者的数目,但必须知道至少一个同伙的存在。针对有组织犯罪打击的特效,当下共谋罪在英美国家出现了扩张适用的态势。将共谋描述为犯罪准备进而作为预备犯处罚是片面的,因为它忽略了“共谋而不参与执行”的特征。为履行国际条约义务、切实打击有组织犯罪,我国应借鉴共谋罪立法,于危害国家安全罪、危及公共安全的暴力性犯罪上设立共谋罪。     

论伪造证据的犯罪

中外刑法都有关于伪造证据犯罪的规定。我国《刑法》关于伪造证据的犯罪包括伪证罪、辩护人、诉讼代理人伪造证据罪、帮助伪造证据罪。基于现行立法的缺陷,应增设民事、行政伪证罪和伪造证据罪,废除辩护人、诉讼代理人伪造证据罪。     

英美刑法中共谋罪的立法检视与省思

共谋罪作为一种未完成形态犯罪,主要存在于英美刑法中。共谋罪的设立对打击有组织犯罪、恐怖活动犯罪等严重犯罪具有重要意义,通过提前适用刑法来保护法益,为国家提前发动刑罚权提供了正当性依据,适应了英美国家风险社会犯罪的情势。但共谋罪也具有一定缺陷,其造成的处罚过于提前也存在滥用和任意发动刑罚权的潜在风险。鉴于共谋罪立法利弊兼具,我们应当审慎对待共谋罪立法,并根据我国犯罪态势,扬长避短,完善我国刑事立法和司法,推进我国刑法现代化。     

吸毒入罪可行性研究

在我国刑法理论界和实务界,“吸毒入罪是否可行”的争论一直都未真正停止过。基于尊重并保障人权,建设法治国家的前提下,不宜将吸毒行为犯罪化,即吸毒入罪不具有可行性,为此,从吸毒行为本身的特性、不宜为犯罪行为、不符合入刑必要性原则要求以及替代措施之于刑罚的必要性、合理性、科学性与可行性等视角进行分析和论证。

The Reader Response Approach to Teaching of English Literature

During interview with English majors, it was found that a majority of students expressed disappointment with their experience of English literature classes. Students' dislike of learning English literature appears to be the major problem of teaching English literature in China. Reader response approach is a good way to solve this problem. In this paper, I explain the rationale behind the reader response approach, such as its origin, definition, features, assumptions, and strategies. Then I illustrate how reader response approach works as a teaching strategy by presenting several teaching models. At last I evaluate its usefuiness for teachers and present the advantages of reader response approach in Chinese context.
