我国银行破产重整制度的构建

商业银行作为市场经济条件下的重要市场主体之一,同其他市场主体一样,既要在竞争中发展,也有可能在竞争中失利而退出市场。但是,相对于其他企业而言,商业银行的破产将会带来更大的社会影响,因此,建立符合本国国情的商业银行破产重整制度十分重要。鉴于银行业在国民经济中的特殊地位,银行破产重整不能简单适用一般商事企业法人的破产重整程序;基于本国特有的国情,银行破产重整也不能简单照搬外国银行破产重整制度。构建我国科学、实用、高效的银行破产重整制度,必须兼顾我国的金融法制现实,坚持与银行破产立法理念相一致的破产重整原则,设计适合中国银行业现状的破产重整启动程序,强化银行破产重整监督机制。     

泉州市商业银行流动性状况研究

我国银行监管的问题分析及对策研究

我国银行业监管发展的历史较短,再者监管问题与政治、经济和金融体制紧密相关,这使得建立起一个健全、高效、规范化的银行监管体系具有一定的复杂性和艰巨性.由于建立完善监管体制,提高监管效率,能够最大程度地保护广大存款人利益,维护银行业稳定,因此,其将成为监管部门面临的一个紧迫而又关键的课题.在此背景下,本文对我国银行监管的现状及存在的问题进行分析,为完善我国银行监管体系提出了建议.     

德国银行监管模式研究

德国银行监管是采用实施货币政策执行机构与银行监管机构相分离的监管模式。联邦信贷监督局作为银行监管的主体,秉承稳定性、效率与公平的监管原则,在市场准入、资本充足性、流动性、贷款集中程度、信息披露、市场退出等方面对银行进行全面的监管。德国的银行监管遵循两大基本准则,准则I涉及资本管理,准则II主要涉及流动性管理。多年以来,有效的监管机制对德国降低银行的经营风险、保护消费者、促进市场的透明、保证金融市场的稳定、促进金融资源的有效流动方面做出了重要的贡献。我国面临金融业开放的挑战,完善银行监管制度是避免出现银行体系系统性风险的必要保证。     

The Struggling Egos in a Harsh Society

As social beings, men can not avoid being affected by the dominant ideologies of their time. At the same time, asanimals with intellect, they inevitably have their own passions and thoughts. When thrown into a society, they will constantly findthemselves tortured by their natural self and their social consciousness. In the face of such a conflict, ego, which refers to therational, thoughtful and realistic personality process, plays its part in meditating the conflict. By discussing briefly the three maincharacters' struggling egos in The Scarlet Letter, we can see clearly that Nathaniel Hawthorne's work reflects the above fact. heholds that man is not able to escape the influence of the society, on the other hand, he is not the least dismayed at human beings'comparative mental freedom.     

Counseling Incest Survivors:

The sexual abuse of children is receiving increased attention, and the counseling of adult survivors of a childhood incest experience continues to grow. This paper applies a conceptual framework representing women's experiences using the metaphor of voice to structure a group therapy process. The purpose of the group, formation of collaborative relationships among members and therapists, plus procedures and interventions, reveal the nature of the group process. Data from college women incest survivors illuminate the process of change, noting family messages, the presence of an inner and outer voice, and the integration of the two voices.

Harsh corporal punishment of Yemeni children: occurrence, type and associations

OBJECTIVE: To examine the occurrence, type and associations of harsh corporal punishment in Yemen. METHODS: Caregiver and teacher reports were obtained on 1,196 Yemeni 7-10-year olds obtained by systematic random sampling of children in the 1st to 4th grades of urban and rural schools. Caregivers (86% mothers) reported on disciplinary practices, socio-familial background, and child psychopathology. Teachers reported on school performance and child psychopathology. RESULTS: More than half of the rural caregivers and about a quarter of the urban caregivers reported using harsh corporal punishment (hitting children with implements, tying them up, pinching them, or biting them). Harsh corporal punishment was significantly associated with poor school performance and both behavioral and emotional difficulties. The socio-familial factors that were independently associated with harsh corporal punishment were: rural area, male gender of the child, low maternal education, and large family size. CONCLUSION: Harsh corporal punishment is very common in Yemen. International findings suggest that the association with school failure and psychological maladjustment may well be causal. Promoting parental use of effective and non-violent disciplinary methods should be a public health priority. Practice implications: Yemen urgently needs to develop and evaluate programs that teach parents how to use culturally appropriate rewards and non-abusive sanctions to shape children's behavior without stunting their academic and emotional development. Persuading parents to adopt such approaches may need programs that focus not just on techniques but also on attitudes, e.g. challenging the commonly held belief that children will not develop properly unless they are beaten when they do wrong.
