试论关于“罪刑法定原则”的几个问题

在刑法理论上．罪刑法定原则被称之为“刑法的铁则”,也被称为刑法的理论基石,它的价值与功能是其他刑法原则无法替代的。我国1997年《刑法》采用直接规定的模式确立了“罪刑法定”的基本原则,标志着我国的刑法向现代刑、科学刑、民主刑迈出了坚实的一大步．但是在司法实践过程中,罪刑法定原则如何得以真正贯彻,还有很多问题需要解决。本文就罪刑法定原则在法律实践存在的几个问题进行分析并提出了完善该原则的几点球议．     

试论缔约过失责任

缔约过失责任制度由德国法学家耶林于1861年提出,被誉为法学上的发现,对各国立法和判例产生了深远的影响。关于缔约过失责任的法律基础大致有四种学说:侵权行为说、法律行为说、法律规定说、诚实信用原则说。我国《合同法》规定了缔约过失责任的四种类型。     

原则的背叛——析我国《刑法》之自相矛盾

本文主要是从立法的角度来分析我国现行刑法典中的一些自相矛盾之处,着眼点在于我国《刑法》中的一些具体规定对于其本身规定的三项基本原则:罪行法定原则,罪刑相适应原则,适用刑法人人平等原则的背违,当然刑法的基本原则也需要在司法的实践中得以现实化,但是这必须是在有法可依的前提之上的,这个法必须是一个我们可以信赖的,明确的好法。
