The Present Situation of Chattel Guarantee System and Its Improvements—Taking the Angle of American Uniform Commercial Code(UCC)

Although there are appropriate stipulations for the chattel guarantees in the law of China, this guarantee system could not adapt to the request of economy’s development because of the following reasons: the scope of chattel guarantees is narrow according to relevant stipulations; the transaction cost of the chattel is high; mortgage registration of chattel is in a mess; lack of efficiently executive guarantee system, etc. To counter the problems existing in the present Chinese chattel guarantee system, in this article, the author proposed some corresponding suggestions and countermeasures, hoping to perfect the chattel guarantee system in China.     

Reflections on the application of the western reproduction theory in the research into the education of China

The ＂reproduction theory＂ was conceived and born in the research into educational inequalities in Western countries. Famous as the theory is, when it is to be applied in the research into education in China, a few factors must be taken into consideration： the subjects investigated must be educational inequalities that have come into being in the context of China; a shift in theoretical approach and expression is needed, with the Functional approach as the dominant research method; in terms of the standpoint of the researcher, whose academic mission and realization of social ideals should be closely and fully integrated; in terms of research method, the principle of combining both the macroscopic and microscopic approaches and analysis on the basis of actual facts should be adopted so as to effectively analyze and solve the problems plaguing the education of China and to promote the localization of the western reproduction theory in China.

Inclusive education： Proclamations or reality （primary school teachers＇ view）

This paper deals with 2 focal points of inclusive education, which is the integral segment of the current education reform in the Bosnia and Herzegovina： its position in various proclamations and in primary school teachers＇ reality, i.e., legislative aspects vs. everyday situation in primary schools. The survey research was carried out through the 5-level Liken scale, on the sample of 105 primary school teachers working in Herzegovina-Neretva Canton （specific for its education reform implementation）. The aim was to examine the attitudes of the direct implementators of the education reform and the inclusive education （2003-2009）--primary school teachers, with particular reference to： teachers＇ acquaintance with inclusive education requirements; their involvement in its designing, planning and organization; relevant professional education; school preparedness for inclusive education; level of partnership with relevant subjects; and evaluation of the inclusive education implementation. The results obtained have indicated exactly the lack of the mentioned as the main issues of the implementation of inclusive education within compulsory primary schools in Herzegovina-Neretva Canton. Therefore, this paper gives a kind of guidelines for the improvement of the inclusive education, derived directly from the teachers＇ everyday experiences, problems, proposals, notes and suggestions.     

Specifications of OCLC CJK Bibliographic Records And the Adoption of CJK Records from Asia

OCLC Online Computer Library Center, the largest library automation network in the world, links nearly 20,000 libraries in the Uaited States and 60 other countries and territories. Introducing a library automatian network of Chinese, Japanese, and Korean(CJK) characters in 1986, OCLC operates the largest CJK library network in the world in terms of the member of online CAK institutional asers. As of January 1, 1995, OCLC had 40 CJK users in the United States, Aastralia, Hong Kang and Taiwan. As of October 1, 1994, there were nearly 850, 000 unique CJK bibliographic records in the OCLC database. OCLC is interested in sharing the CJK bibliographic records, especially in loading CJK records created in Asia into the OCLC database. To this end, OCLC has entered into an agreement with the National Central Library, Taiwan; the National Library of China, and Waseda University, Japan, and is in negotiation to load the Japan-MARC records. Sharing of CJK bibliographic records between libraries in Asia and those in the United States is a complex task as the CJK records created in Asia and those created in the United States are not compatible. This paper explains the specifieatioas of the OCLC CJK records, and lists eight areas where the incompatibility exists. The following five areas of incompatibility are due to different cataloging practices: 1. AACR2; 2. name and subject authorities;3.romantzation; 4.subject headings; and 5.ctassification schemes. Three additional areas of incompatibility are technical in nature; 6.MARC format; 7.character set; and 8.internal code.

Value Choice and System Enlightenment of the U.S.Business Judgment Rule

Through analyzing theories and legislative cases in respect of Business Judgment Rule in American justice systems with the com parison method,this article reveals that the business judgment system is conducive to the protection of rights and interests of the directors in decision making,and enables the court to avoid the substantive review on business management in an effective manner;at the same time,in view of the blanks and deficiencies in the legislation of China in the "Company Law" and other relevant laws,it is recommended that the Business Judgment Rule be introduced into China and the legislation in respect of director accountability be strengthened,while the direc tors fiduciary duty and other supporting systems be improved,with the reference of the U.S.practice,to clarify the legal boundary between rights and responsibilities of directors.

On the C-E Translation of Cultural Information in Tourist Publicity Materials

This article roughly retrospects the idea of school voucher program proposed by Milton Friedman, lately developed by Peacock, Wiseman and Jencks. The reasons like privatization in education, deterioration of public schooling and school choice promote this program. Then taking a simple look at the ramification of voucher program＂ and its value inclination and the practice of school voucher program in the USA and the problems existing in America. Finally, this paper introduces the school voucher program practiced in China and the enlightenments that school voucher program can offer to the education reform in China. With the idea and practice of school voucher program, the introduction of the market mechanism benefits the innovation of education fiscal system, the competition between schools, improvement of the education quality and parents＇ needs of school choice; it benefits the development of non-governmental education; it helps to build a better school governance situation. We should use two forms of constitutional transformation to ensure the widespread of school voucher program in China.     

Analysis of 1D consolidation with non-Darcian flow described by exponent and threshold gradient

Numerous experiments have shown that the water flow in fine-grained soils can obey an exponential relationship at small gradients and a linear relationship when the hydraulic gradient exceeds a certain limit. Based on the non-Darcian flow described by exponent and threshold gradient, the theory of 1D consolidation is modified in this paper to consider a linear variation in the vertical total stress with depth and the effect of ramp loading. The numerical solutions were derived in detail by the finite difference method for excess pore water pressure and the average degree of consolidation. Finally, the influence of various parameters on consolidation behavior was investigated. The results show that the rate of consolidation is reduced when non-Darcian flow described by exponent and threshold gradient is adopted in the theory of 1D consolidation. As well the distribution of vertical total stress has a great influence on the dissipation of excess pore water pressure, either for pervious top and pervious bottom （PTPB） or for pervious top and impervious bottom （PTIB）. For the case of PTIB, the distribution of vertical total stress in a foundation has a great influence on the rate of consolidation; however, for the case of PTPB, the rate of consolidation is independent of the distribution of vertical total stress. The rate of consolidation is dependent on the ratio of the thickness of a soil layer to the equivalent head of the final average vertical total stress; the greater the value of this ratio, the slower the rate of consolidation. Finally, an increase in construction time reduces the consolidation rate of a foundation. Thus, consolidation behavior of 1D consolidation with non-Darcian flow has been thoroughly acquainted in this paper.     

Self-desiccation mechanism of high-performance concrete

Investigations on the effects of W/C ratio and silica fume on the autogenous shrinkage and internal relative humidity of high performance concrete (HPC), and analysis of the self-desiccation mechanisms of HPC showed that the autogenous shrinkage and internal relative humidity of HPC increases and decreases with the reduction of W/C respectively; and that these phenomena were amplified by the addition of silica fume. Theoretical analyses indicated that the reduction of RH in HPC was not due to shortage of water, but due to the fact that the evaporable water in HPC was not evaporated freely. The reduction of internal relative humidity or the so-called self-desiccation of HPC was chiefly caused by the increase in mole concentration of soluble ions in HPC and the reduction of pore size or the increase in the fraction of micro-pore water in the total evaporable water (Tr/Tte ratio).     

Study on Learning Motivation of Higher Vocational Colleges Students in Tianjin

Learning motivation occupies an important position in non-intelligence factors,as it plays a pivotal role in university students’ successful completion of their studies and strengthening of professional knowledge base.However,the present university students generally lack motivation in higher education.This research used questionnaire method,which is a questionnaire random sample in 500 students of learning motivation from four comprehensive higher vocational colleges of Tianjin,and explores the status quo of learning motivation in higher vocational students of Tianjin.The result shows:The learning motivation level of higher vocational colleges students is above middle level;Male on the learning motivation total level is significantly higher than female;Rural students in the learning motivation on the aggregate level is significantly higher than that of urban students;Look from the different grades,sophomore students have lowest level of learning motivation;Freshmen learning motivation is at highest level.
