美国儿童虐待的法律保障——以佐治亚州“儿童虐待示范立法协议”为例

儿童虐待是一个严重的社会问题,它危害儿童身体、社会性、认知和情绪的发展.美国佐治亚州将儿童虐待分为忽视、躯体虐待、性侵犯、性剥削、情感或言语虐待五种类型,并通过举报、调查和评估、审理等程序防止或减轻儿童虐待产生伤害.基于佐治亚州的经验,我国应该通过制定关于儿童虐待问题的专门法律、成立专门的儿童虐待处理机构、健全儿童虐待案件的司法程序等手段保障儿童的权益.     

我国儿童虐待防治的法律分析

作为联合国《儿童权利公约》的缔约国,我国有着较为完善的儿童保护法律体系。但近来校园虐童案时有发生凸显法律空白。本文通过介绍国内儿童虐待防治的立法现状,分析目前儿童虐待法律制度存在的不足,并提出相应的完善建议,以期为完善儿童虐待防治的配套法规提供借鉴。     

中日儿童虐待状况的分析与比较

目的:探索中日两国儿童虐待方式等方面的规律,进而了解儿童受虐待的现状和影响因素.方法:采用社会分类学方法,从儿童虐待类型、施虐者与受虐者的关系、影响因素、虐待者的经济状况、受虐者的性别和年龄特点等方面,对中国124例和日本170例儿童虐待案例进行分析.结果:身体虐待和期待过高是儿童虐待的主要类型;日本生母虐待儿童率明显高于中国生母的儿童虐待情况.家庭经济状况不好,虐待发生率高;中国女孩受虐率高于男孩,日本则相反;0～2岁虐待发生率最高,随年龄增长,性虐待率增大.结论:日本生母虐待儿童率高于中国生母的儿童虐待情况,中国女孩受虐率高于男孩,日本则相反.

Elder Abuse in Japan

ABSTRACT

Perceptions of elder abuse were examined in Japanese women (n = 100) and men (n = 46). Japanese women and men both emphasized physical aggression, followed by neglect and blaming, when giving examples of extremely abusive behavior. Physical aggression was also the most frequently mentioned type of moderate elder abuse, followed by neglect, economic maltreatment, emotional abuse, verbal abuse, blame, and psychological abuse. Japanese women provided significantly more psychological neglect responses than verbal aggression responses when giving examples of mild abuse. Paired samples t tests revealed that physical abuse responses were given significantly more often as examples of extreme abuse than of moderate or mild abuse. Findings have implications for addressing the conflict between changing family relationships and traditional cultural values—such as filial piety—in Japanese society.

Concealment of Child Sexual Abuse in Sports

Researchers and theorists offer a strong base of research in physical activity for high risk groups, particularly sedentary children, adults, and the elderly. Little research examines the lifelong healthy movement behaviors of former competitive athletes. This paper raises some important questions relevant to this population, in particular the disturbing, yet limited research pointing to a serious failure of former competitive athletes to necessarily live longer, healthier, and more physically active lives. The scarce research that seems to highlight this neglected problem is outlined and hypotheses that may contribute to this phenomenon are offered and categorized in the following three sections: atypical physical behaviors found in the sporting realm, utilitarian uses of physical activity, and the long-term consequences of athletic identity. Suggestions are offered to direct future research and to implement practical intervention strategies and educational programs.

本文基于现象学的视角,对近期发生的浙江温岭虐童事件以及相关现象进行分析.通过“悬置”,呈现事实及相关现象;通过“还原”,讨论事实及现象背后的问题;通过“反思”,寻找避免类似事件再度发生的策略,这其中包括政府要切实承担起发展幼儿教育的责任,幼教行业要加强自律性的专业伦理规范建设,幼儿园教师要坚守幼儿教育的基本价值,社会要给予幼儿园教师更多的理解和支持,等等.     

Critique of the Definitions and Ideologies of Child Sexual Abuse that Underpin Current Educational Texts for Teachers

Teachers in a large, all-male urban school in Jordan were interviewed about their perceptions of the most frequently occurring student misbehaviour. It was hoped to be able to identify the causes of such ‘disruption’ to teaching and learning in the school. Teachers spontaneously identified eight forms of student misbehaviour, which reflected clearly different kinds of interference with the teacher's authority. Teachers showed great awareness of the constraints which operate in the school context, which in turn affect their means of managing discipline in the classroom. Though this study was undertaken in a context which is significantly different from England, it is interesting that the issues these teachers saw themselves confronted with were not significantly different from those reported in this country. The conclusions that the researchers draw from their data have relevance beyond the specific context in which this study was undertaken.
