<正>尊敬的家长朋友们：党中央、国务院部署“双减”工作以来,我省各地各部门综合施策、协同发力,省域内学科类校外培训机构已全部压减,非学科类校外培训机构治理逐步规范。为进一步规范非学科类校外培训机构培训行为,切实有效维护您和孩子的合法权益,防止校外培训机构“卷款跑路”“退费难”“非法机构开展培训”等事件发生,做到校外培训监管工作全范围覆盖、全流程监管,教育部建立了“全国校外教育培训监管与服务综合平台”,“校外培训家长端”APP是“全国校外教育培训监管与服务综合平台”的一款配套软件,该APP属于公益性、全免费的应用软件。     

“双减”背景下校外培训机构的法治化监管

自“双减”政策出台以来,我国在义务教育阶段文化课校外培训机构监管方面取得了一定进展。但此类校外培训机构的监管仍存在各种问题,主要表现在对校外培训机构监管立法上存在欠缺、执法上监管合力不强等方面。为实现校外培训机构监管的法治化,对构建校外培训机构监管长效机制进行了研究。通过分析我国校外培训机构监管的现状,从促进监管部门有效承担监管职责、鼓励学校提升教学效果、引导家长塑造正确教育理念等方面提出了合理化建议。     

校外教育培训的法治化监管

2021年7月“双减”政策出台以来,校外教育培训监管进入了新阶段,对校外教育培训机构进行法治化监管成为必然选择。法治化监管能够突破传统监管路径的局限,克服校外教育培训的种种弊端,保障培训机构的良性运作。校外教育培训的法治化监管需要遵循依法依规监管、保障合法权利、全过程精准监管及多元协同监管等基本原则。在具体制度构建中,法治化监管的实现需要以保障合法权益为核心完善相关法律规范,以校外教育培训的类型化为方法建立精准监管执法基准,以监管体系制度化为依托构建长效监管模式,以多元主体监管为目标构建协同化监管机制。     

如何立法监管校外教育培训机构

“双减”政策对我国校外教育培训机构监管提出新的挑战。推动校外教育培训机构监管立法既是规范校外教育培训市场秩序的必然要求,也是推进依法行政和依法治教的内在动力。国家对校外培训机构治理的重视和已有的立法基础证明立法时机已经成熟。校外教育培训机构监管立法首先应处理好立法名称、调整对象、模式选择及其在教育法中的地位等理论定位问题,并确立倾斜保护原则、属地管理原则、全过程监管原则和合作治理原则等立法原则。在此基础上,应从总则部分的构成要素、变更与终止规则、监管工具、法律责任条款、监管权力规制体系等方面进行制度建构。     

民办校外培训机构:定位与监管

民办校外培训机构存在的问题主要集中在定位与监管方面。民办校外培训机构正确定位是私人物品性质的公益事业,这就意味着民办校外培训机构可利用市场治理手段走产业化道路,同时政府进行必要的规制与监管。政府监管主要包括研制民办校外培训机构的国家标准、工商部门履行监管主体角色、教育评估组织参与治理及建立健全信用信息系统等。     

国外校外培训机构治理:现状、经验、问题及其启示

校外培训机构存在于学校教育系统之外,但对素质教育的全面实施和学生的健康发展产生越来越多的影响,如何科学规范校外培训机构的发展、提升校外培训机构治理水平,是国内外共同关注的现实问题。各国政府在培训机构治理方面有着不同的举措,研究认为,完全禁止校外培训往往是无效的,提高学校教育质量是关键因素,需要防止教师在校外培训的腐败行为,加强政府资助的校内课外培训。国外在校外培训机构治理上往往存在着价值取向的困境、文化传统的惯性、政策工具的矛盾等问题。我国在实现校外培训机构治理能力提升过程中,要警惕教育改革助推校外培训,切实提高学校教育质量,加强教师自律和校外培训机构行业监管,充分利用现代化技术手段,加强政府与社会的合作。     

"治理型监管"视角下我国校外培训机构监管问题分析

作为基础教育的补充,被称为“影子教育”的校外培训行业近年来蓬勃发展,各类培训机构呈爆发性增长。但与此同时,教育机构管理面临市场失灵和监管失灵的双重困境。传统的主张政府作为唯一监管主体的监管一元论难以有效应对当下的复杂环境,因而需要通过政府、非政府及各类社会主体共享监管权、协同监管来实现校外培训机构的法治化监管。一方面,政府作为管理的主体,应完善政策法律的内容与程序规定,对校外培训机构治理进行系统规划,提高教育机构准入的门槛和加强法律的执行力度;另一方面,社会组织、高校、市场和消费者共同参与监管,实现以人为本、鼓励创新和包容审慎的协同监管范式。因此,将“治理型监管”的理论融入我国校外培训机构的监管法治化机制建设,有助于提出建立以政府为主导,行业协会、市场主体等多方协同的监管机制,加强过程监管,弥补事后监管的空缺,同时也是对“治理型监管”本土适用性以及话语体系构建的加强。     

长沙市开福区：树立“服务型”理念 奏响执法“三部曲”

<正>“双减”政策实施以来，长沙市开福区抓实校外培训机构规范管理，以“基础工作有序，特色工作抓实，亮点工作突出”为原则，确保校外培训机构规范办学、良性发展。目前，开福区共有实际办学行为的校外培训机构61所，其中学科类校外培训机构25所，非学科类校外培训机构36所，全部实现资金监管100%、课程上架100%、购课消课100%的全流程监管，监管资金共计900余万元。与此同时，对于违规办学行为，区委教育工作领导小组牵头抓总，联合推进综合执法体系项目试点，有的放矢地对其进行规范管理，     

校外培训监管立法路径的区域比较——以东亚地区为例

校外培训是我国学校和家庭教育的补充,需要明确的法律体系规制。“双减”政策实施以来,完善校外培训监管体系、促进校外教育良性发展对校外培训监管法律的制定和实施提出了新要求。我国已颁行的《中华人民共和国民办教育促进法》(以下简称《民促法》)、《教育行政处罚暂行实施办法》等法律法规,难以适应“双减”政策背景下校外培训的监管和执法。通过分析日本、韩国和我国台湾地区有关校外培训监管的法律规定路径,发现它们的校外培训监管法律的修订与完善在其教育的改革发展进程中发挥了重要作用,其立法和实施经验为我国校外培训机构监管法律体系的进一步建构和完善提供了借鉴和启示。

随着新一轮校外培训机构专项治理政策的实施,校外教育的乱象得到有效遏制。但是,校外培训机构治理依然面临着严峻的挑战。校外教育作为学校教育的有益补充,确保其健康有序发展极为重要。注重教育资源配置的公平性,强化政府对教育的责任是优化校外培训机构治理成效的前提条件;优化学校教育教学,不断推进考试评价制度改革是强化校外培训机构治理的关键所在;兼顾多措并举,建立和完善校外培训机构治理长效机制是强化校外培训机构治理成效的重要保障;普及科学的教育理念,缓解家长和学生对校外教育的焦虑是强化校外培训机构治理成效的落脚点。应不断推进校外培训机构治理政策深入实施,促使校外培训机构与校内教育一道协同育人,共同实现立德树人的任务。
