关于航班延误的法律分析

航班延误下机场对旅客的契约责任

航班延误一直是民航运输业发展的顽疾，明确法律责任主体是整治航班延误的重要途径。传统的契约法理论只认可航空承运人的责任主体身份，否认机场的契约责任。实际上，机场和旅客之间存在服务合同，“旅客须知”和“服务事项”构成机场发出的要约，旅客经由进入机场的行为完成承诺。确定机场对旅客的违约责任应摒弃一般性的无过错责任原则．转而适用过错责任原则．在因果关系的认定上应纳入狭隘的直接因果关系规则。机场承担独立的契约责任．并不是航空承运人的并列或补充连带责任主体。     

国内民用航空旅客运输延误的民事责任研究

民航总局2012年《民航航班正常统计办法》提出"航班延误"的计算公式,明确了航空公司作为航班延误承运人所应承担的义务与责任。为了进一步保护旅客的权益,规范航空公司的服务水平,仍应从立法和政策方面完善民航延吴民事责任制度。
