美国式的辩诉交易是在美国当事人主义诉讼架构下的自然产物 ;美国发达的律师制度是辩诉交易有效适用的保障 ;泛化的契约文化观念为辩诉交易提供了合法性的文化基础 ;社会普遍接纳的实用主义哲学是辩诉交易产生并成长的思想基础 ;案件的压力和司法资源的有限性是辩诉交易盛行的直接原因。 2 0 0 2年 ,我国黑龙江省牡丹江铁路运输法院适用“辩诉交易”审结了一起故意伤害案后 ,引起了广泛的讨论 ,有人主张现在就应该引进构建中国式的辨诉交易。虽然我国目前不具备引入辩诉交易的法律制度基础与文化观念基础 ,由于我国也面临案件激增的压力 ,从长远看 ,有引入此项制度的必要。现在 ,我们要做的工作是目前我国应为借鉴辩诉交易制度积极创造运行的条件、配套措施 ,改进和完善相关的制度环境 ,待条件初步具备时 ,再从立法上考虑引入此项制度     

论“辩诉交易”在我国的不适用性

“辩诉交易”是英美法系国家的一种刑事诉讼制度,有诸多缺陷,我国不能盲目移植。在我国,“辩诉交易”不适用,它违反了我国刑法和刑事诉讼法的基本原则,它与“依法治国”的基本精神背道而驰;从刑事司法实践来看,它不利于刑事司法的统一,还可能纵容在刑事司法中的权钱交易,而且在现有的“简易程序”之下,“辩诉交易”无存在的必要。
