由“彭萃案“引起的法律思考——谈行政时效及行政执法中“法“与“情的冲突

行政主体行使公共权力的行为应该受到法律的约束这已是不争的事实。然而法律应该怎样约束公共权力的行使则仍有不少有待探索的问题。其中包括：应建立行政时效制度，对行政主体行使公共权力的行为进行时间上的约束，既保证国家权力的及时行使，又充分保护行政相对人的合法权益；行政执法中经常会产生执法与“情理”相冲突的情况，如何分析认定冲突的原因、如何解决冲突等。     

高等学校行政主体地位探析

我国的行政主体概念过于褊狭,行政主体应该主要是政府但又包括不限于政府的社会公共机构和行为者,国家并不是唯一的行政权力中心。行政机关与行政主体的概念是存在差别的,高等学校虽然不是行政机关,但是应该具有公法意义上的行政主体地位,能够依法行使行政权力、承担行政法律后果。     

依法行政与行政程序法律化

拥有强大权力的行政主体必须依法行政,以防对行政管理相对人合法权益的侵害。行政权的行使不仅要有法律依据,而且必须遵守法定程序。实体行政法律规范正是借助程序的中介作用对行政行为予以约束和控制,依法行政的实质与核心是依行政程序法行政。行政程序法能将行政权力的行使真正置于法律规范的约束之下,保障行政管理相对人的程序权益,提高行政效率。依法行政呼唤一部统一的行政程序法早日出台。     

再论“行政裁量”概念——兼谈“行政裁量”分类

行政裁量指的是行政主体依据法律规范及其目的,按照自己的理解自行判断是否作为以及如何作为.而通俗点说,行政裁量权就是有关行使行政裁量的原则性权力.根据行使过程可将行政裁量分为两大类即决定裁量与选择裁量.针对不同种行政裁量行为确定不同的审查因素与审查条件,有利于行政机关规范行政裁量权的运作,防止行政裁量权的滥用,保障行政相对人的合法权益,有利于对行政裁量进行综合性的监督与制约.

论村民行政诉权

法律对村委会的行政诉讼被告主体地位规定不明确,仅把村委会的部分行为纳入民事诉讼的范围,易形成诉讼上的盲区。村民自治权对村民来说是一种内部的公共权力,村委会可以被看做是村民自治组织的执行机构,故村委会行使村民自治权的行为也具有公共权力的性质。笔者认为,只有将村委会行使村民自治权的行为纳入行政诉讼的受案范围,才能更好地保护村民的行政诉权,同时还应当加强对农村法律知识的宣传和对村民行政诉权保护方面的研究。
