毒品犯罪诱惑侦查获取证据的采信问题

诱惑侦查是世界各国查获毒品犯罪案件的常用方法,在我国也得到了广泛应用,部分地区高达八成以上的毒品案件采用了诱惑侦查手段。然而,对于诱惑侦查的合法性以及通过诱惑侦查手段所获得证据的效力,理论研究中尚存在着争议,司法实践中看法不一。针对当前毒品犯罪诱惑侦查获取证据面临的采信问题,笔者作一肤浅探究。

法国诱惑侦查制度及其对我国的借鉴

近年来,随着诱惑侦查在司法实践中的运用愈加广泛,相关的法律问题也随之凸显出来。《刑事诉讼法》中对诱惑侦查的含糊其辞,混淆了诱惑侦查与技术侦查的概念;在何种案件中适用诱惑侦查、前提条件等都不明确,现有的合法性认定标准不合理。现阶段,我国诱惑侦查批准权归公安机关,而诱惑调查批准权归属不明,并且没有设置监督机构,易造成诱发侦查、调查机关权力滥用;而且,能够有效救济被追诉合法权益的途径有限。与国内立法、司法实践相较,同为大陆法系的法国诱惑侦查制度已经发展得较为成熟,借鉴法国成功的经验,在我国明确诱惑侦查的概念及适用的案件范围与条件,确立"客观为主,主观为辅"的合法性认定标准,实行完备的司法审查制度,进一步完善对被追诉人合法权益的救济,从而使诱惑侦查的优势得到最大限度的发挥。     

论刑事诉讼中诱惑侦查的法律控制

诱惑侦查是一柄双刃剑,既有其合理性,同时又存有弊端.诱惑侦查必须遵循一定的原则.以前作为侦查敌特案件主要手段的诱惑侦查如今被大量使用在隐蔽性犯罪、集团性发犯罪案件的侦破上并且取得了巨大的成功,但是由于我国对诱惑侦查立法的缺失和理论研究的滞后,使得诱惑侦查在司法实践中常被滥用、错用.因此,必须对诱惑侦查进行法律控制.     

两种类型诱惑侦查所获证据的有效性分析

诱惑侦查有多种分类方法,比较恰当的是将其分为“机会提供型”和“犯意诱发型”两类。“机会提供型”诱惑侦查是合法的,其所得证据可以被采纳;“犯意诱发型”诱惑侦查是非法的,其证据不能被采纳。因此,要将两种类型严格区分,以防在办案中将其混淆,出现违法行为。在具体实践当中,应从适用的范围、适用的对象、诱惑强度以及审批程序等方面进行必须的规制,将诱惑侦查活动纳入法治轨道。
