试论法律移植的主体

本在明确法律移植主体问题既是我国法制建设和社会发展的需要，也是法律移植秩序化和我国法律体系完整性要求的基础上，从狭义的法律移植角度和宽泛的法律移植角度对法律移植主体构成进行阐述，认为法律移植主体应依法拥有法律移植权，而法律移植权属于立法权的范畴，故法律移植主体应具有专属性，就我国法律移植的现状而言，我国应尽快地法律中明确法律移植权的归属，使法律移植主体合法化、规范化。     

全球化时代的中国法律文化

法律文化包含显型法律文化和隐型法律文化两个层面。全球化时代的中国法律文化所面对的，其实是如何面对外来法律文化和如何认识自身的法律文化传统这两个主题。主张“法律文化全球化”和“法律文化保守主义”都是错误的，也是不可能的。我们应该以更加科学的态度，打破法律文化的封闭性，在深入认识和研究中西法律文化相融与相异方面的同时，更好地学习借鉴西方法律文化的精华，更有力地弘扬中国法律文化的优秀传统，从而实现中国法律文化的现代化。     

对法律逻辑学形式化定位的否定性思考

在近现代的法学研究和法律实践的过程中，法律的逻辑性问题受到了普遍的关注，从而促使了法律逻辑学的产生。然而，由于对法律逻辑的性质、特点、研究对象等问题存在着不同的认识，关于法律逻辑学的定位问题成为建构科学的法律逻辑学体系，促进法律逻辑学发展急需解决的首要问题。本文主要从我国法律逻辑学发展的历史和对法律逻辑形式化的局限性分析的角度，对法律逻辑学形式化定位予以否定性思考。     

入世与法学教育改革

中国即将加入WTO。经济入世必将推动法律入世，使我国法律体系以及包括立法、执法、司法在内的整个法律体制面临前所未有的挑战，引发和促进法律新一轮的改革。要应对这种挑战和改革，我国法学教育也必须进一步改革和发展。一、入世给法律的发展提供了广阔的空间经济入世加快了经济全球化的进程、进而加快了法律全球化的进程。法律全球化首先意味着法律向全世界开放，这就要求增加法律的透明性、可预测性、可计算性。其次，意味着法律超越国界，国内法与国际法的界限，特别是涉及商务、金融、知识产权等方面的法律界限将日益缩小和淡化，…     

法学教学中的职业化教育反思

法学教育的改革必须以培养目标观念的改革为前提，即法学教育不仅要传授法律知识，同时要培养和训练学生的实际操作应用知识的能力。法学的教学改革，笔者认为应立足于法学的法律执业技能训练和法律职业化思维的教育，以从根本上改变法学学生只了解法律术语和条文的现状，使他们能掌握法官、律师以及其他法律职业工作者应当具备的技巧、思维、能力和素质，发展学生自身的潜能，使法律教育更加适应法治建设和法律职业化的需要，培养应用型法律人才。

法律教育的目的就是培养具有法律知识、法律技术、法律观念和法律信仰的法律人。根据我国法律传统、法律制度体系和社会经济文化的特点，着重从法律教育模式的定位和相应教育体制的构建方面，宏观地探讨了我国法律教育的目的及其实现方式。

以邓小平法制思想为指导加强高等院校的法制教育

高等院校是法制教育的重要基地。良好的法律素质首先包括丰富的法律知识和健康的法律心理，法律教育应以此为切入点，着眼于法律意识的培养、法律素质的提高和法律观念的树立。必须更新教育观念，变过去的“专才”教育为“素质”教育，大力提高青年大学生的法律素质，以适应依法治国，建设社会主义法治国家的需要。     

评"法律规范由行为模式和法律后果构成"

认为法律规范由行为模式和法律后果构成的观点同传统的“三要素说”(认为法律规范由假定、处理和制裁构成)相比，有进步，但仍然存在需要商榷之处。笔者认为规范适用的条件应属于法律规范的逻辑构成要素，法律后果不是法律规范的逻辑构成要素，法律后果本身就是一个完整的法律规范。     

法律教育,还是法治教育?

●法律是法治的必须，但是，有法律并不一定有法治。不符合法治精神和原则的法是无法实现法治的。法治需要法律的保障，也需要法律教育的支持。但是，法律教育不同于法治教育，法律教育不能代替法治教育。辩证认识两者的关系，其意义在于，科学认识普法、法律教育的作用，以及解决普法普及什么的问题，对大学生的有关教育而言，我们的教育重心应该放在哪里。 ●我们进行法治建设，与其说需要进行法律教育，进行所谓的全民普法，不如说将最浅显的法治的理念、法律的精髓和实质告诉民众，传授给民众。 ●改进对高校学生法律教育，就应该从法律教育转向法治教育，就要改变法律教育目的在于守去的片面认识，着眼法治社会建设的需要，着眼大学生承担的使命，全面提高学生的法治素养。
