环境权范畴研究述评

关于环境权的性质，学界大致有六种观点：一曰环境权是一种基本人权，是人在优良环境中生存、发展的权利，这是一种宪法权利；二曰环境权是一种精神美感权；三曰环境权是一种物权，包括环境相邻权和环境使用权；四曰环境权是一种产权；五曰环境权是公民享有的环境公众参与权；六曰环境权是一种环境救济权。本文认为，环境权是一种公权和私权结合的权利，具有私益性与公益性双重属性。环境权是环境法的基础和核心，是一系列法律制度设计的基础。     

公民环境参与权论

当前公民参与环境的实例越来越多,赋予公民享有单独的环境参与的权利,对于现阶段的环境保护和公民环境权的实现具有十分重要的理论与现实意义。公民参与环境权作为公民所享有的一种独立的权利也逐渐得到人们的认可。实际上,公民环境参与权是一种与时俱进的集合性、多元性权利。其产生有着深刻的法哲学和经济学上的理论基础,更有其独立存在的价值。公民环境参与权是环境共益权与自益权的统一,是长远利益与眼前利益的统一,是环境直接利益和间接利益的统一,是公民环境参与权利和环境参与义务的统一。公民环境参与权与其他公民权利,并行不悖。     

环境保护中公民参与的法理和路径分析

环境权是环境保护中公民参与的法理依据,公众参与环境保护的权利就是把环境权概念具体化后派生出来的。公众参与环境保护的路径包括通过立法创设环境保护公众参与的权利基础、环境行政参与制度的构建、公民环境司法参与、建设民间环保组织,构建公民参与环境保护的平台和载体。

公民居住环境权是公民合法享有生活居住环境利益的一项重要权利,以环境权一般理论为基础,对公民居住环境权的概念、性质进行分析,并对其内容进行探讨,认为公民居住环境权的内容主要有实然性权利和程序性权利两类,包括居住环境使用权、居住环境安全权、居住环境洁净权、居住环境状况知情权、居住环境参与监督权、居住环境损害赔偿请求权等。     

建构我国环境权法律制度刍议

对于人与环境关系的诸多认识中保护环境的观念可谓由来已久,但是提出并形成独立的环境权概念和体系却是晚近的事情,距今也不过半个世纪。所谓环境权是指公民、法人等组织团体和人类(包括后代人)所拥有的享有适宜健康和良好生活环境,合理利用环境资源以及有效参与国家环境管理和决策的权利。它包含程序性权利和实体性权利,是一种新型人权。     

我国环境权概念的反思与重构

在构建我国环境权概念时，其内涵不应当囊括自然资源开发和利用的权利，程序性的环境权利应排除在环境权之外，要注意环境权只是环境权利的一部分，而且不应该把环境权主体扩展到自然体。环境权是指环境法规定的公民、法人和其他组织对其生存环境所享有适宜的生态环境的权利，包括清洁空气权、清洁水权、清洁产品权、环境审美权、环境文化权、合适的日照权、环境安宁权和户外休闲权等。     

公民环境权与企业环境资源使用权

在法律的层面上,公民环境权是宪法和行政法上的权利,实质上是一种请求权;企业环境资源使用权既可以是民法上的物权,也可以是行政法上的请求权,二者之间是对立统一的关系。公民享有环境权有利于遏制企业滥用环境资源使用权,有利于实现人与自然的和谐。协调公民环境权与企业环境资源使用权的矛盾应当坚持一般利益优于特殊利益并兼顾特殊利益的原则,平等保护原则,利益权衡原则。     

论环境司法中的公众参与:一个法理和制度分析的框架

公众参与环境司法能够从公民环境权等思想资源中寻求到理论支撑,也能够从协商民主、合作治理等理论框架中得到自足性解释。但在我国的环境司法实践中,公众参与面临诸多制度困境,需要从理念上塑造和强化民主、权利和责任观念,在制度上放松对非政府组织的行政管制和完善环境公益诉讼制度。

Let F be a class of graphs G such that F={G|K(G) is a tree}. In this paper the graphs in F having independent clique-transversal sets are shown and thus TC (G)/|G|≤1/2 for all G ∈ F.
