基础融贯论视域下法学论文教学思路的塑造——基于论文个案的分析

基础融贯论是苏珊·哈克在批判基础论和融贯论的基础上提出的一种新的认知辩护理论。该理论有效克服了基础论和融贯论的缺点,赢得了广泛赞誉和应用。文章以一堂论文案例教学为例,用基础融贯论引导学生,通过证据探究的纵横字谜图景解释模式培养学生的逻辑思维。学生在论文案例学习中学会了自主建构和理解、能动地选择和创造,并最终生成自己独特的体验过程。这样的教学加强了学生的学术训练,凸显了对学生法律逻辑思维能力的培养。     

哈克的基础融贯主义仍是基础主义

基础主义与融贯主义是相互竞争的知识辩护理论。它们各有自身无法克服的难题。哈克认为基础主义和融贯主义之间存在其它知识辩护理论的逻辑空间,即存在一种融合基础主义和融贯主义的基础融贯主义理论。这种理论能够克服基础主义和融贯主义的难题。阐发基础融贯主义的关键是区分信念状态与信念内容。但这种区分实际上并没有成功地支持哈克的理论。哈克的基础融贯主义本质上仍是一种基础主义。哈克理论不成功的根源在于它继承了个体主义和绝对真理知识观。     

真之统一多元论

塔斯基提出的作为真之定义的T模式,引发了关于"真"的收缩论和膨胀论的争论。文章提出另一种真之定义即T'模式,作为对T模式的补充,从而改进了塔斯基的语言层次论,并将真之收缩论和膨胀论统一起来。在普特南的"内在实在论"的基础上,文章对"存在"和"事实"加以界定,对"内在符合论"给以澄清,并阐明真之实用论和真之融贯论的作用及其关系,从而将真之符合论、实用论和融贯论以及收缩论和膨胀论统一起来。     

真和先验逻辑--康德真理观的现代逻辑哲学解读

知识理论与真之理论紧密联系在一起,康德的先验逻辑关于知识说了很多,关于真却说得很少。康德的真之理论既不能简单地认为是符合论,也不能简单地划归于融贯论。引入当代逻辑哲学成果,从真之定义、形式和质料标准、真之载体等方面分析先验逻辑中真之观念,可以对康德的真之观念作一种实用论的解读。准确把握康德的真之理论,既可以促进对先验哲学的理解,又可以促进对逻辑哲学中真之理论的研究。
