论行政信赖保护原则

行政信赖保护的理论研究和法制化建设在我国刚刚起步，在行政立法和执法中没有贯穿信赖保护原则这样一个核心思想，与此相关的制度也极不完善。市场经济的发展，建设中国诚信体系的现实需要以及民主与法治建设的推进等对建立和完善我国信赖保护原则及相关制度提出了迫切要求。要借《中华人民共和国行政许可法》颁布和实施的契机，加强信赖保护的理论研究，树立政府诚信的观念，进一步进行信赖保护的制度建设，推进以信为本，以人为本的行政法治目标早日实现。     

信赖保护原则在行政法领域的应用

当前我国提出全面推进依法治国的战略部署,依法行政是法治国家的基本要求。信赖保护原则作为行政法领域中的一项基础原则,对建设法治政府具有重要意义,其适用范围也相当广泛——抽象行政行为、具体行政行为以及行政主体的其他一些行为中都渗透着信赖保护原则。信赖保护原则的适用对于约束行政主体的行为、平衡社会与个人之间的利益有重要作用。     

可撤销行政行为之信赖保护

信赖保护原则是行政法上的—般原则 ,其集中体现于可撤销行政行为适用问题上 ,具体适用于对行政相对方与第三人信赖利益的保护上。同时行政法治的健全完善需要对可撤销行政行为之信赖保护制度进行创新 ,包括行政法自身研究路径的选择     

论信赖保护原则在司法审查中的适用

行政法之信赖保护原则，是指有权机关保护行政法律关系的利害关系人，因信赖行政行为而期望得到的合法或合理利益，所应遵循的行政法原则。作为当前我国行政法理论与制度中的重要原则，行政法之信赖保护原则在依法治国、依法行政进程中具有重要地位和作用。司法机关，特别是法院在诉讼活动中适用信赖保护原则，是实现其价值和作用最主要的方式；也是法院提升自身地位，推进法治建设的重要行为。     

论行政许可法中的信赖保护原则

信赖保护原则在许多国家和地区的行政法中得到确认或体现，我国新制定的《行政许可法》中确立了这一原则。信赖保护原则有其特定的涵义、适用范围和方式，信赖保护原则的法理依据存在于法律价值与法的本质中，信赖保护原则的确立对于促使政府的诚信、保护人民的合法权益以及促进中国法治建设等有重要意义。     

浅析我国行政法上的信赖保护原则

我国行政法学理论的发展起步较晚,并强调行政机关的管理职能,强调行政主体代表的是公共利益,坚持行政合法性原则和行政合理性原则,对于行政信赖保护原则不够重视。我国法学界对信赖保护原则的研究不多,立法中也少有明确规定,实践中运用得更少。分析我国适用行政信赖保护原则时存在的问题,提出完善此原则的建议,以助其发挥规范行政机关的行政行为,保护行政相对人的合法权益,塑造诚信政府的功能。     

违法建筑行政裁判中信赖保护原则之适用——以308份裁判文书为考察对象

运用统计方法，以结构化形式对涉及违法建筑信赖保护原则的308份行政裁判文书加以分析发现：66%案由是因相对人不服行政机关对违法建筑所作的行政决定；行政相对人主动援引信赖保护原则作为诉求理由的有219份。就裁判结果而言，行政相对人援引并且法院采纳的有23份，行政相对人没有援引但法院主动适用并据此裁判的有39份；就理由叙明而言，法院适用或不适用信赖保护原则需要权衡多种因素。围绕典型案例，违法建筑信赖保护原则司法适用的焦点问题主要是：未取得许可证是否可以直接认定涉案建筑违法并予以无偿拆除；法院直接适用信赖保护原则时如何进行充分说理；法院适用信赖保护原则如何进行利益衡量。司法实践的启示在于，若要实现信赖保护原则制度化，需要对违法建筑作形式违法和实质违法之区分；完善违法建筑信赖利益行政补偿制度；优化违法建筑信赖保护司法审查规则；健全违法建筑信赖利益保护程序规定。

一、信赖保护原则概述 信赖保护原则确立于2004年7月1日颁布实施的《中华人民共和国行政许可法》。《行政许可法》是一个重大的制度创新,这是我国首次以法律的形式在行政法律规范中确立信赖保护原则。
