我国未成年人网络隐私权保护探析

目前国际社会普遍注重对未成年人网络隐私权进行保护,其中美国、欧盟采取的保护模式具有典型性和参考价值。我国在未成年人网络隐私权保护过程中面临着法律保护不足、行业自律机制缺位的问题,加上未成年人网络隐私权自身具有易受侵害的特点,无疑加大了保护难度。在分析美国、欧盟保护模式利弊的基础上,从立法层面进行保护、加强行业自律、明确家庭学校所应承担责任3个方面提出完善我国未成年人网络隐私权保护的建议。

本文以隐私权的内涵为起点,试图探究隐私权理论在美国产生和发展的脉络,进而阐明美国法是如何对公民的隐私权进行保护的,并在分析现代科技发展和时代背景对隐私权保护所构成的威胁和挑战的基础上,对美国隐私权保护的现状进行评述,以期有助于人们深化对隐私权的理解,强化人们维护自己合法权利的意识,以为我国立法提供借鉴。
