We examine patent licensing business models of non-practicing entities that generate revenue by selling, licensing, or litigating patents. They may also pursue R&D activities, invent new technologies, or provide services to inventors or product companies. We describe their business models and patent market behavior and then compare their litigation strategies against product companies using a matched sample of highly comparable patents. The main differences among patent licensing firms stem from their technological capabilities, patent portfolio sizes, and external relationships. We find that licensing firms with technological capabilities often pursue litigation until decision and engage in forum shopping. In contrast, litigation incidence, parties involved, and outcomes are primarily determined by patent characteristics, not entity types. Licensing business models drive the acquisition of certain types of patents that influence the outcomes of the patent system. We argue that patent policy should strengthen mechanisms to discover invention quality rather than focus on the amount of litigation or types of entities.  相似文献

Teacher-student relations have a significant correlation with student motivation, academic performance and discipline. For example, the meta-analysis by Hattie (2009) revealed an effect size of d = 0.72 for the effect of relations on achievement, and the meta-analysis by Finn, Schrodt, Witt, Elledge, Jernberg & Larson (Communication Education, 58(4), 516–537, 2009) showed a correlation of 0.55 between the perceived care by teachers and student achievement. These were established by comparing students, but comparisons of schools or countries with high or low levels of teacher-student relations are missing. The present paper analyses the correlation between teacher-student relations and Programme for International Student Assessment (PISA) 2009 results in science and mathematics on three levels: student, school and country level. The study shows a weak positive relationship (correlations up to 0.16) at the student level, and a positive relationship (up to 0.34) at school level. The multilevel analysis revealed a negative relationship between teacher-student relations and PISA results (r = ?.51) at the country level. To understand the negative relationship, also known as an ecological fallacy, the countries were grouped into geographical regions in which the relationship was insignificant and the positive effect of teacher-student relations was found by comparing with some neighboring countries. Implications for practice and further studies are proposed on the basis of these findings.  相似文献

Abstract

Speed of movement in a lateral adductive arm swing was timed at seven equidistant points on an arc of 120 degrees. Static strength and effective arm mass were measured in the movement position. Data obtained on 36 men and 36 women were subjected to a centroid factor analysis. The structure for both sexes consisted of a single common factor for arm speed and a substantial item-specific factor for the first 17 cm. of movement, suggesting that the velocity curve probably consisted of two components. The correlations between the strength/mass ratios and speeds of movement were almost zero, except in the middle phase of the action, where the relationship was .29 for men and .27 for women (.36 and .34 when corrected for attenuation). These very low correlations supported the hypothesis of neuromotor specificity. Circumferential speed for women was 17 percent slower than for men, partly because their arms were shorter. In angular speed, the sex difference was only 5 percent.  相似文献

On September 7, 1983, the U.S. Department of Education announced a nationwide adult literacy initiative designed “... to promote functional literacy for the entire adult populations.” The department is committed to conducting several activities to attack and solve the problem of adult literacy. Two of the activities pertain specifically to postsecondary education. They are:
  • ? working with postsecondary education institutions to develop demonstration programs utilizing college work-study students in adult literacy programs;
  • ? promoting college student involvement through literacy tutoring experiences in college courses and through student volunteerism.
  • The authors believe that there should be much greater participation in the initiative by postsecondary education institutions, and they propose that more extensive participation can be attained through the institutions' performance of their usual functions of teaching, service, and research.  相似文献

    The primary purpose of this study was to determine if muscular endurance is affected by referenced waist circumference groupings, independent of body mass and subcutaneous abdominal fat, in women. This study also explored whether selected body composition measures were associated with muscular endurance. Eighty-four women were measured for height, weight, body mass index (BMI), waist circumference (WC), and abdominal skinfold thickness (SFAB) and performed 60-s sit-ups (SU) and maximal push-ups (PU) tests. Mean differences in SU and PU scores were tested across three groups based on WC as follows: WCG1 < 70 cm; WCG2 between 70 and 89 cm; WCG3 > or = 90 cm. There were no significant differences in SU and PU scores between WCG1 and WCG2. WCG3 had significantly lower SU and PU scores compared to the other groups. After adjusting for the influence of SFAB, BMI, and weight, the differences disappeared. The regression analysis revealed a two-variable (BMI and SFAB) model that accounted for the variation in SU performance. For PU, only BMI loaded into the regression model. The results of this study suggest that women with a WC > or = 90 cm have decreased muscular endurance compared to their lower WC counterparts. This difference is related to higher body masses.  相似文献

    This paper describes the international co-operation experience in teaching control engineering with laboratories being conducted remotely by students via the Internet. This paper describes how the students ran the experiments and their personal experiences with the laboratory. A tool for process identification and controller tuning based on spreadsheets like MS-Excel is outlined. Process identification and modelling can be carried out for the open- and closed-loop control circuit. Controller tuning is done according to the criterion of cascaded damping ratios. The design is based on a direct relation between the parameters of the process and the controller. Tuning for optimal set-point control as well as disturbance rejection is provided.  相似文献

    This study explores general‐chemistry instructors' awareness of and ability to identify and address common student learning obstacles in chemical equilibrium. Reported instructor strategies directed at remediating student alternate conceptions were investigated and compared with successful, literature‐based conceptual change methods. Fifty‐two volunteer general chemistry instructors from 50 U.S. colleges and universities completed an interactive web‐based instrument consisting of open‐ended questions, a rating scale, classroom scenarios, and a demographic form. Survey respondents who provided responses or described remediation strategies requiring further clarification were identified (n = 6); these respondents amplified their views in separate, researcher‐led semistructured phone interviews. All 52 responding chemistry instructors reported and identified common student areas of difficulty in chemical equilibrium. They reported employing a variety of strategies to address and attempt to remediate students' alternate conceptions; however, these self‐reported strategies rarely included all four necessary conditions specified by Posner, Strike, Hewson, and Gertzog (Science Education, 66, 211–217, 1982) to stimulate conceptual change. Instructor‐identified student alternate conceptions were congruent with literature‐reported alternate conceptions of chemical equilibrium, thus providing validation support for these compilations.     This study investigated the prevalence of food insecurity among community college students (N = 301) and the relationship between food insecurity and student grade point average (GPA). It employed a cross-sectional intercept survey, utilizing the U.S. Department of Agriculture’s Household Food Security Survey Module, student self-reported GPA, and demographic variables. The research setting was two community colleges in Maryland—one located in a low income urban area and one located in an affluent suburban area. Results demonstrate that 56% of the students in the overall sample were classified as food insecure. Students at higher risk of food insecurity included those who reported living alone and those who reported being single parents. Students identifying themselves as African American or as multiracial were also at increased risk for food insecurity. Food insecure students were more likely than food secure students to report a lower GPA (2.0–2.49) versus a higher GPA (3.5–4.0). Data suggest that food insecurity is an issue for a large percentage of the community college student sample. Food insecurity may have adverse effects on student academic performance and is a factor to be considered by college administrators, faculty, and students.  相似文献
