在近现代四川盐业契约珍贵的诉讼档案中,反映出以盐业生产经营过程中各方约定俗成的厂规习惯来解决股权纠纷的特点。在诉讼程序的各个阶段,诉讼参加人自觉依据习惯法来谋求达成解决纠纷的合意,从而达到最大限度节约司法资源,降低诉讼成本的目的。分析盐业诉讼中的股权纠纷特点,借鉴我国传统纠纷解决方式中的有益成分,对于推动我国民事诉讼制度的转型和发展有着积极的意义。  相似文献

A constitutive model for methane hydrate-bearing sediment(MHBS)is essential for the analysis of mechanical response of MHBS to the change of hydrate saturation caused by gas extraction. A new elasto-plastic constitutive model is built in order to simulate the mechanical behavior of MHBS in this paper. This model represents more significant mechanical properties of MHBS such as bonding, higher stiffness, softening and stress-strain nonlinear relationship. The bonding behavior can be described by use of a parameter related to mechanical hydrate saturation. Higher stiffness can be modeled by the introduction of hydrate saturation into traditional expression of soil stiffness. Softening can be controlled by a function describing the relationship between cohesion and bonding structure factor. Dilatancy can be estimated by establishing the relationship between the lateral strain and axial strain. Meanwhile, the hypothesis of isotropic expanding is applied to the calculation of the volumetric strain. The stress-strain curves under different hydrate saturation conditions predicted by the proposed model are in good agreement with the test data. All the coefficients can be easily obtained by the triaxial test of MHBS.  相似文献

We used the Rule Space Model, a cognitive diagnostic model, to measure the learning progression for thermochemistry for senior high school students. We extracted five attributes and proposed their hierarchical relationships to model the construct of thermochemistry at four levels using a hypothesized learning progression. For this study, we developed 24 test items addressing the attributes of exothermic and endothermic reactions, chemical bonds and heat quantity change, reaction heat and enthalpy, thermochemical equations, and Hess’s law. The test was administered to a sample base of 694 senior high school students taught in 3 schools across 2 cities. Results based on the Rule Space Model analysis indicated that (1) the test items developed by the Rule Space Model were of high psychometric quality for good analysis of difficulties, discriminations, reliabilities, and validities; (2) the Rule Space Model analysis classified the students into seven different attribute mastery patterns; and (3) the initial hypothesized learning progression was modified by the attribute mastery patterns and the learning paths to be more precise and detailed.  相似文献

Many studies have found a strong relationship between the mathematics students study in school and their performance on an academic or school mathematics assessment but not on an assessment of mathematics literacy (ML). With many countries, like the USA, placing emphasis on finishing secondary education being mathematically literate and prepared for college or career, this raises the question about the relationship between the mathematics studied in school and any ML students may have. The Programme for International Student Assessment (PISA) ML assessment is embedded in real-world contexts that provide an important window on how ready students are to tackle the situations and problems that await them whether they intend to pursue further education beyond high school or intend to go directly into the labour force. In this paper, we draw upon the PISA 2012 data to investigate the extent to which the cumulative exposure to rigorous mathematics content, such as that embedded in college- and career-ready standards, is associated with ML as assessed in PISA. Results reveal that both exposure to rigorous school mathematics and experiencing the instruction of this mathematics through real-world applications are significantly related to all the real-world contextualized PISA ML scores.  相似文献
