天一阁藏明刻本《学政录》是嘉靖中期福建提学官朱衡颁布的学政条例。《学政录》不仅是海内孤本文献,也是目前所知明代最早单独成书的提学条例,对于研究明代学校和生员考试均有重要的参考价值,对于了解风宪官巡历、放告制度在地方的运作情形亦有所裨益。该文献对岁考和提学官巡历、放告等有翔实记载,于他处鲜见,具有较高的史料价值。  相似文献

我国自1995年正式实施《国家赔偿法》以来,在保障人权和制约、监督行政机关依法行政以及司法机关公正执法等方面发挥了重要作用。然而,随着这部法律的实施,其存在的不足和缺陷逐步暴露出来。其中,赔偿程序问题、赔偿范围问题、赔偿标准问题以及国家赔偿费用支付问题,一直是颇具争议的问题,亦为众多学者所诟病。本文针对国家赔偿法归责原则上的缺陷,指出在法律适用中存在的有关问题,提出完善国家赔偿的法律适用方面存在问题的建议和相应的完善措施,对现今社会主义法制建设有着十分重要的现实意义。  相似文献

The rise of the knowledge economy has generated new global infrastructures with information technology playing an increasingly important role in the global economy. The popularity and prominence of information technology not only changes the nature of knowledge but also restructures higher education, research and learning. It is in such a wider policy context that an increasing number of institutions of higher learning are being established with new missions and innovative configurations of training, serving populations that previously had little access to higher education. Apart from accommodating a larger number of students, higher education institutions are required to improve their administrative efficiency and accountability in response to the demands of different stakeholders like government, business, industry, and labour organizations, as well as students and parents. The present article sets out in this wider context to examine how and what strategies universities in Hong Kong have adopted to promote entrepreneurial spirit and practices by encouraging academic staff to venture in industrial, business and commercial fields. In addition, this article examines how universities in Hong Kong reform their curricula to make students more creative, innovative and international. More specifically, this article reflects upon the role of the Government of the Hong Kong Special Administrative Region (HKSAR, hereafter) in promoting entrepreneurship, with particular reference to the interactions between the government, the private sector and the tertiary education sector in promoting a vibrant and dynamic economy.  相似文献

This paper explores the growing power of states in transnational regulatory policies for nanotechnology risks and thereby their impact on research and technology trajectories. Decentralization of governance structure has been reported by scholars, yet the role of the state is evolving and still underexplored. We draw on a case study of nanomaterials and chemicals policies, by analyzing recent regulatory developments in the EU and US. Using data-reporting and market-entry regulations as examples, the evidence demonstrates the expansion of state-centric market-oversight rulemaking, and ‘stronger’ patterns of centralization in the EU. We argue for a significant increase in regulatory power exertion, countering predominant views on decentralization as the prevailing governance response. These findings suggest the adaptation and strengthening of state-based regulatory systems in the context of scientific uncertainty and complexity of global nanotechnology settings; despite these challenges for policy making, the EU and the US are increasing government role in technology regulatory policy.  相似文献

This article is motivated by interest in the deployment of massive numerical information produced by national examinations in the practices of control and steering. It examines how data generated in the compulsory school graduation examination in the Russian Federation connect together different actors within the education system and beyond, and the nature of the relationships so formed. These questions take as their unit of analysis the relations and relationships created and/or re-ordered through numbers, and they unmask who utilizes the numerical data, and for what purpose. The article brings together two major arguments in the existing literature on quantification, and develops them further into a coherent research framework which is then applied to capture and interpret the circulation and application of the examinations data. The first argument suggests that governance by numbers, characteristic of contemporary regulation practices, relies on and promotes the parallel existence of soft and hard regimes of regulation. The second addresses the increasingly public nature of social statistics, that is, its circulation on both official and popular levels. The article illustrates that it is by means of analysing the overlappings and interdependencies between the soft and hard regimes, and the two levels of data entry, that we can best understand how numbers exercise power and how they become rooted and gain more power in the process.  相似文献
