合同成立与合同生效是两个不同的概念 ,合同成立不一定生效。合同如果不符合法律规定的有效要件 ,就是无效的 ,就不具有法律拘束力。无效合同因具有违法性 ,所以当事人不得依据合同实际履行 ,否则将承担违法的法律后果。《中华人民共和国合同法》不仅对无效合同的认定提供了具体标准 ,也对无效合同的法律后果作了相关规定 ,在处理案件时应予适用     

对正确处理人民内部矛盾与思想政治教育关系的现实研究

关于如何处理新时期人民内部矛盾的问题，笔认为，正确的做法应该是针对现阶段经济、政治、思想和化领域人民内部矛盾的不同特点和表现，综合运用经济的、政治的、行政的、法律的方法和手段去解决，多管齐下．综合治理。而在运用每一种手段时，都必须贯穿民主原则，进行有效的思想政治教育。     

The effect of interactivity on initial interactions: the influence of information valence and modality and information richness on computer‐mediated interaction

Research investigating relationship development through computer‐mediated channels has failed to acknowledge the importance of initial interactions. Increasingly, multimodal forms of communication, such as audio‐ and videoconferencing, in addition to text‐only formats have emerged on socially oriented websites designed for relationship initiation. Utilizing the principle of interactivity as a conceptual framework, the present study investigates whether increased structural interactivity provided by the additional aural and visual modalities influences initial interaction processes and outcomes online. The results indicate that increased availability of nonverbal modalities, combined with the valence of the information acquired, significantly affected interaction involvement and mutuality, which are markers of processual interactivity, as well as the interaction outcomes of uncertainty, predicted outcome value, and information seeking. Additional analysis revealed that mutuality mediated the effect of richness on postinteraction uncertainty level and the evaluations of future relationship potential.     

图书馆文献资料呈缴制度的几点建议

我国自20世纪初便制定了相关的图书馆文献资料呈缴制度,并随着时代的发展将电子出版物纳入呈缴范围。国家图书馆作为我国最大的呈缴文献收藏机构,收缴效果不理想,一些出版单位存在不缴、少缴、漏缴的行为。对此,国家图书馆应与图书馆界同仁共同努力,督促国家尽早出台《图书馆法》,扩大宣传呈缴的重要性,加强与新闻出版职权机构的合作,减轻呈缴单位的负担,同时建立对呈缴单位的补偿机制,建立呈缴奖惩制度。

Romantic Relationship and “Yuan”: A Preliminary Study of Chinese in Hong Kong

This study investigated how the traditional Chinese concept of “yuan” influences perceptions of romantic relationships. A small-scale survey of young people in Hong Kong indicated that the belief in yuan was prevalent among respondents. In addition, a significant, positive correlation was observed between participants' belief in yuan and relationship satisfaction. However, romantic love was a better predictor of satisfaction and commitment than was the belief in yuan.     

A Patient-centered Approach to Breaking Bad News: Communication Guidelines for Health Care Providers

This investigation takes a patient-centered approach to examining strategies physicians use to deliver bad news to patients. Qualitative data were obtained from 68 patients who had received a message they perceived as negative information from a health care provider. Through grounded theory methodology, patient accounts were examined to reveal four provider strategies for breaking bad news. This investigation underscores the importance of using effective communication strategies to achieve patient satisfaction and compliance.     

The Rise of the Small: The Effects of Industry Consolidation on Small Legal Publishers

Summary

The legal publishing industry has experienced waves of acquisition and consolidation, with almost all of the established players becoming affiliated with either Thomson or Reed Elsevier. A widespread assumption is that this consolidation is driving out the smaller participants in the market, especially in conjunction with the expansion of free Web sites for primary source material. It is presumed that the entrepreneurs who have smaller, profit-based companies are becoming less interested in the market due to financial pressures, increased difficulty of capturing market share, and threat of acquisition (friendly or hostile).

In order to confirm or refute this assumption, the author reviews the industry consolidations, describes the delineation of representative small legal publishers, and analyzes their responses to questions about how the recent industry changes have affected their strategies, markets and product lines. The resulting picture is of an environment much different than that painted by current media pundits. Contrary to the presumption of a disappearing landscape of small players, there is a positive perception of “ripe opportunity” pushing companies into this marketplace-companies armed with new technology tools and strong convictions that they can reach customers ready and willing to do old business in new ways. The small publishers seem to be weathering the climactic industry changes, and have expectations of growth and expansion.     

Depicting Experiences

This paper argues that photography is a helpful tool in understanding the ways people experience the world. Five arguments are presented in order to support this statement, each built on the methodological idea that respondents are asked to take, or produce, their own pictures related to a particular phenomenon under investigation. The arguments are: new unconventional methods enhance educational inquiry; photos can serve as communication bridges between strangers; photography makes it easier to represent a situation; photos can be regarded as complex expressions of the photographer's relation to the world; finally, photos enhance the expressing of feelings. These arguments are further discussed in the context of outcomes of a study, which used photography to probe ecological understanding. It is concluded that a deliberate use of the methodology will enhance not only the way photos might be used in research but also enrich educational research aiming at capturing the way people experience and relate to the world surrounding them.
