在我国采取虚假广告欺骗消费者,给消费者造成损失的事情时有发生。但要从法律上规范广告行为,赋予消费者民事赔偿请求权是一个重要的手段。根据广告的法律性质,消费者对于虚假广告的民事赔偿请求权主要有两种,一种是基于缔约过失责任的请求权,另一种是基于单方行为说引出的违约责任的民事赔偿请求权。

Who pays? Who benefits? Who decides?

This paper was presented at the symposium dedicated to the 25th anniversary of the publication of Patrons Despite Themselves: Taxpayers and Arts Policy (Feld et al. 1983), held by the Association for Cultural Economics International, Boston, June 2008. It considers alternative means of providing indirect tax-based state support of the arts, such as the use of tax credits as opposed to tax deductions for charitable contributions, matching grants, and support applied to specific projects. It also considers the problem of broad-based changes to tax policy that have unintended consequences for arts organizations.      

Two games in town: a comparison of dealer and auction prices in contemporary visual arts markets

The article tests a couple of hypotheses relating to markets where demand is not taken as a given, but subject to sophisticated and encompassing price-building strategies. The study uses a data set that provides quoted dealer prices for medium-sized works of 100 leading visual artists from 1970 to 2004. These data are compared with auction price results for works by the same artists. The study reports significant discrepancies with respect to the relationship between the age of artists and prices paid for their works in the two markets, and with respect to general price developments in the two markets as measured by indices.

‘Salk Hops’: Teen Health Activism and the Fight against Polio, 1955 – 1960

In the late 1950s, a health charity, known as the National Foundation for Infantile Paralysis (March of Dimes), organized American teens into volunteer divisions to fight polio, as well as tame adult anxieties surrounding juvenile delinquency. The alliance that developed permitted the NFIP to increase its influence and revenue, while granting teens an opportunity to assert their cultural power and challenge negative stereotypes. Although the NFIP nurtured and at times dominated the relationship, young volunteers joined for their own reasons and shaped the program to suit their own aspirations and interests.     

速度轮滑转项速度滑冰的国内外现况研究

摘要：目的：北京携手张家口申办2022年冬奥会成功,冰雪运动热潮正在掀起。但冰雪项目总体发展受到地域性限制。为了实现“北冰南展西扩”的战略目标,加强速滑项目人才的梯队建设,国家体育总局冬季运动管理中心速滑部借鉴国外优秀运动员的训练和比赛经验,提出了“轮转冰”项目。本文结合理论依据与实践成绩探讨“轮转冰”项目的可行性。方法：通过文献检索CNKI、pubmed等数据库,登录国际滑联官方网站以及国内速滑官方网站,收集整理在册速滑运动员过往经历和成绩。并通过专家访谈收集国内外知名的速滑教练及运动员的经验与建议。结果：1）研究速度轮滑与速度滑冰项目共性的文献一共7篇。速度轮滑与速度滑冰在起跑姿势、滑跑姿势、直道滑跑技术和弯道滑跑技术以及能量代谢方面都具有相通之处;2）既往国际上“冰陆双栖”的运动员,男子运动员有21名,其中有16名获得过世锦赛或奥运会奖牌;女子运动员有14名,其中有10名获得过世锦赛或奥运会奖牌;3）国内“轮转冰”运动员以郭丹为带头人物,她是目前中国仅有的1名轮滑世界冠军,2015年4月正式转项速度滑冰。在2016年1月的全国第13届冬运会速滑赛场上位列女子5000米比赛前8名,因此获得入选速度滑冰国家队的资格。结论：1）速度轮滑和速度滑冰项目具有极大的共性,轮滑运动员身体素质和技战术的储备具有转项速滑的能力,保证了该项目的可行性;2）国际上轮滑冰运动员的训练经历和出成绩的时间规律,为中国“轮转冰”项目的实施提供了借鉴依据。     

中晚唐文人对藩镇的态度

安史之乱后,强藩割据成为中晚唐最大的痼疾,而中晚唐的文人对于藩镇问题却态度不一,这其中有着深厚的历史原因。而在科举过程中的不同际遇是造成中晚唐文人对藩镇态度分野的重要原因。科举是文人入仕的主要途径,但每年科举之后文人就会被分为及第与落第两个群体,以此而入朝为官的必然会支持朝廷,而屡考不中的难免会失望,心生怨恨,敌视朝廷,这也就造就了文人对藩镇的不同态度。探讨文人对藩镇的态度有利于更细致、更深入地了解唐代的藩镇问题。     

高校钢琴教育的民族化问题研究

随着人们物质生活的丰裕,人们越来越注重精神文化的享受,聆听音乐便是其中的形式之一。在众多乐器当中,钢琴是优雅的艺术,是精神的盛宴。钢琴教育民族化是中国钢琴发展的必经之路,但是就目前发展现状而论尚存在一些问题,针对新时期高校钢琴教育的民族化发展提出了几点意见。     

刑事案件上诉原因文本挖掘——基于二审文书数据

[目的/意义]从刑事二审案件裁判文书中挖掘上诉理由和相关影响因素,给法院和智慧量刑系统提供相关数据。[方法/过程]以北大法宝网近一年的刑事二审案件裁判文书作为基础数据,用信息抽取、word2vec训练词向量和聚类等文本挖掘方法对文本内容进行挖掘。[结果/结论]在传统的上诉理由之外,发现了基于上诉人自身态度的上诉理由。信息抽取、word2vec训练词向量和聚类等文本挖掘方法可用于裁判文书相关内容挖掘。
