萨摩亚《公共档案法》述评

萨摩亚是南太平洋的岛国之一,其在档案方面的立法较晚,《萨摩亚公共档案法》是萨摩亚档案法规体系的核心,是萨摩亚的基本档案法。为探究萨摩亚国家档案法发展背景、进程及立法具体情况,给我国以及其他国家的档案法规体系发展建设提供参考与借鉴,研究采用文献研究法、网络调研法和对比分析的方法对萨摩亚《公共档案法》进行了介绍、述评、分析。最后本研究对萨摩亚的《公共档案法》作出了评价与思考,为萨摩亚国家档案工作发展提供参考借鉴。     

我国“杜拜法规”对高校专利与许可的影响研究

运用实证与案例研究方法,评估我国类似美国杜拜法案的法规对高校专利及许可的影响。结果表明:该法规促进了高校专利的增长,但仅是影响因素之一;对高校专利许可的促进作用不如对专利的作用明显;对不同层次高校的专利和许可影响不同。     

College/University Counseling Centers Supporting Study Away: Challenges and Opportunities

Research points to significant numbers of students on college campuses experiencing mental health distress and an ever increasing number of college students who are choosing to make an off-campus educational experience a part of their college careers. When we consider both of these trends together, it is quite apparent that a significant number of students with mental health concerns will spend periods of time studying away from campus, with converging concerns among college mental health and study away professionals about how to best support these students. This article seeks to outline both challenges and opportunities inherent in the collaboration between campus professionals in supporting students with mental health issues before and during their study away experiences.     

美国图书馆法的演进与经验

在系统分析美国图书馆法历史演进的基础上,总结了美国图书馆立法的主要经验：图书馆事业的发展离不开图书馆法的支持、平等理念和人本精神、全国性法和地方法相结合、图书馆法与教育法相联系、图书馆法要随着图书馆事业的发展与时俱进。最后阐述了上述经验对中国图书馆立法的借鉴意义。     

Knowledge and Dignity in the Era of “Big Data”

Private companies and government agencies are now creating and tapping into vastly more data than ever before. These data flows include enormous amounts of personal information and raise questions about privacy and intellectual policy that could have profound impacts on our lives. While data collection and creation are nearly ubiquitous, the instruments of collection and analysis are often hidden in order to track more natural behavior. Recent revelations of massive governmental data collection offer the country, and librarians in particular, an opportunity to discuss and question the societal implications of “Big Data,” and the policies that govern them.     

体育领域年龄歧视的法律规制

年龄歧视是一种新的歧视类型,在体育领域也有体现。主要包括因为年龄歧视丧失从业资格,运动员因为年龄歧视无法获得参赛资格。在美国,《就业年龄歧视法》对规制体育领域的年龄歧视起到了重要的推动作用。

经济危机是市场经济的产物,教育在市场经济国家被视为政府责任,因而经济危机时期在政府的应对举措中,教育往往都是其中的主题之一。本文讨论了在当前国际金融危机背景下,美国经济刺激计划中教育投入所包含的政策导向,并分析了其可能带来的长期影响。     

英国科学数据共享政策法规研究

首先介绍英国科学数据共享的法律基础——英国信息自由法、欧盟数据库指令等,信息自由法的颁布为英国科学数据共享提供了法律保障,并奠定了英国政府在科学数据共享中强有力的作用,欧盟数据库指令为科学数据库产权归属提供了可能;接着分析了英国科学数据共享的指导思想和原则:《布加勒斯特宣言》、《公共资助科学数据开放获取宣言》以及《网络经济的未来:首尔宣言》。最后研究了英国研究理事会、基金会、大学、政府部门等的科学数据共享政策。     

科技成果转化逻辑下被误解的《拜杜法》――概念、事实与法律机制的厘清

长期以来,美国《拜杜法》被视为解决公共研发成果商业化的成功制度范式。但由于中美两国法律制度背景的差异,社会舆论中对《拜杜法》存在着一些流传广泛的误解。在当前中美经贸摩擦形势复杂诡谲多变、我国科技成果转化制度改革已经迈入"深水区"的现实挑战面前,亟待重新从《拜杜法》的法律性质、改革逻辑和制度边界3个方面,全面系统地厘清对《拜杜法》规则及其机制的认识,为恰当应对中美经贸摩擦、推进我国科技成果权属改革提供可靠的制度研究基础。     

The Art of Reading: The National Dutch Reading Promotion Program

The Art of Reading is a national reading promotion program in the Netherlands targeting children and youngsters from birth to 18 years of age. Launched in 2008, the program reached in 2016 nearly 700,000 children. In this article, we describe the program’s background, ambitions, content, and implementation, as well as the central role of the public library in its development and execution. A special focus is on the digital monitoring system that has been created to monitor the impact of the program on pupils’ reading behavior and teachers’ reading promotion behavior.
