试析行政公益诉讼制度设计

近年来，涉及公益诉讼的案件在不断增多，行政公益诉讼成为当前我国法学界的一个热点。鉴于行政公益诉讼制度的价值和我国现状，我国有必要借鉴国外的成功经验建立行政公益诉讼制度。     

教育要重构人的价值世界

现代社会是一个多元文化并存的社会,大众文化走俏、消费文化泛滥,受其影响,人的价值世界日趋平面化、世俗化。人是价值存在,对人生幸福和美好生活的追求是人的本性需求。好的教育必然涉及人的精神品质、关注人的价值世界,它承担着帮助和引导人进行价值探寻、价值决断、价值追求和价值生存的任务,承担着引导人学会过美好生活的职责。     

关于当代人文精神的若干思考

人文精神是在社会生活中起主导作用的文化精神，其内容随着社会的发展而与时俱进。现在，我们国家正在全面建设有中国特色的社会主义，需要的是一种以创造为核心、以和谐为基点、以真善美为导向的新人文精神。     

What traits do academics value in student writing? Insights from a psychometric approach

The number of students studying for university qualifications through the medium of English and for whom English is not their first language has increased significantly in recent years. This, along with efforts to widen access to those under-represented in higher education, has brought into focus the question of what academics see as constituting a ‘good’ piece of student writing. In this small-scale pilot study, Thurstone’s method of paired comparisons was used to establish a scale for ranking six essays in terms of how favourably each was viewed by academic lecturers when compared with every other essay in the set. Kelly’s repertory grid technique was subsequently applied to interviews conducted with the same lecturers to establish which traits they associated with the upper and lower end of the scale. Findings suggest that this methodology represents a promising approach to establishing what academic tutors regard as the key elements of good writing and thus provides an indication of what English teachers might fruitfully focus on in their teaching of the skill.     

善治视阈下乡镇政府与村民委员会关系研究

回顾60多年乡（镇）村关系的演变转化与发展创新,总体上它经历了三个阶段。即乡村政权下的领导与被领导关系、政社合一下的脐带式与民主关系和民主政治下的指导与协助性关系,但在中国民主政治的现实运作过程中乡镇政府与村民委员会间关系出现明显的异化现象：“指导与协调关系”异化为“非均衡性的交换关系”;村民委员会的“自治”异化为“半自治半行政性”;乡镇党委和村支部职能的越位、缺位和错位。在善治视阈下创新发展乡镇政府与村民委员会问关系,使两者真正实现精诚合作与良性互动,这是中国乡村民主政治的趋势所向。     

以自律、他律、法律共铸农村诚信

农村诚信是整个社会诚信建设的一个重要组成部分.当前＂三农＂问题的存在及其对农业发展的影响,在很大程度上来自于农村诚信的缺失,为了解决好＂三农＂问题,促进农民收入增加,就必须以自律、他律、法律为基础建立诚信建设机制,建设农村诚信,促进农业的发展,农村的进步,农民的增收.     

物权法中的善意取得

善意取得又称即时取得,是指无处分权人将其占有动产或登记在其名下的不动产转让给第三人,若第三人在交易时出于善意即可取得该财产的所有权,原所有权人不得追索的法律制度。文章从善意取得的要件,善意取得制度中略存争议的几个问题及善意取得在制度与法律上与其他善意保护制度的区别几方面加以论述。关于赃物是否善意取得,文章赞同有条件地对赃物实行善意取得。     

Using quality enhancement processes to achieve sustainable development and support for sessional staff

Abstract

Consistent with quality enhancement, we report on how we used a continuous improvement cycle to formalise and embed an academic development and support programme for our School’s sessional staff. Key factors in establishing and maintaining the programme included: local change agents supported initially by institutional project funding; School support for key academic and administrative roles; timely access to reports and tools from nationally-funded projects and sessional staff input. Reviewing our approach against national standards highlighted ongoing actions while collaboration with academic developers is critical for advancing our understanding and reviewing our approaches in our continuously changing context.
