Die arbeitsrechtliche Stellung von Lehrbeauftragten im Lichte der Entscheidung VwGH 2005/08/0137 vom 25.4.2007

Die im April diesen Jahres ergangene Entscheidung des VwGH zur Einordnung von Lehrbeauftragten an Fachhochschulen aus arbeits-, sozialversicherungs- und einkommensteuerrechtlicher Sicht hat die Diskussion zur Einordnung der Dienstverhältnisse mit Lehrbeauftragten neu entfacht. Im Rahmen des Aufsatzes beleuchten die Autoren den historischen Hintergrund der Einordnung von Lehraufträgen aus steuer- und sozialversicherungsrechtlicher Sicht und legen dar, wie es zur Einordnung der freien Dienstverhältnisse an Fachhochschulen als "echte" Dienstverträge in sozialversicherungsrechtlicher Sicht gekommen ist. Abschließend wird in Hinblick auf die neueste VwGH-Entscheidung kritisch dargelegt, warum Lehrbeauftragte keine "echten" Dienstnehmer aus arbeitsrechtlicher Sicht sein können.     

小反刍兽疫临床诊断技术研究进展

小反刍兽疫是一种高传染、高致病、高死亡的疫病,被国家列为一类疫病,给养殖业带来巨大威胁。简单、快捷、廉价的小反刍兽疫诊断方法对控制甚至消灭小反刍兽疫至关重要。本文从临床角度对小反刍兽疫的临床症状、剖检变化、胶体金和分子生物学技术在小反刍兽疫临床诊断的发展情况进行论述,为基层畜牧工作者对小反刍兽疫的诊断提供参考。     

Centenary birth anniversary of E. W. Beth (1908–1964)

Evert Willem Beth (1908–1964) was a Dutch logician, mathematician and philosopher, whose work mainly concerned the foundations of mathematics. Beth was among the founders of the Commission Internationale pour l’étude et l’Amélioration de l’Enseignement des Mathématiques and was a member of the Central Committee of the International Commission on Mathematics Instruction, founded in Rome in 1908. Beth and Piaget made an important contribution to research in cognitive development.     

儿童观社会史研究的视野、目的与方法——与日本青山学院大学北本正章教授的网上对话

《儿童观的社会史——近代英国的共同体·家庭·儿童》以Ph.阿里耶斯所开拓的方法,较全面的展现了现代化过程中儿童观变化历史过程的一个典型。本文以与书作者北本正章教授的网上对话形式,从"新历史学"、阿里耶斯的方法、儿童观社会史的目的等角度,探讨构架儿童观社会史的基本思路。     

狄德罗《拉摩的侄儿》与辩证法

首先用微观分析眼光对狄德罗的《拉摩的侄儿》这一哲理小说中包含着辩证哲理的典型妙语与段落进行案例分析；然后又用宏观分析眼光，对黑格尔在《精神现象学》中对《拉摩的侄儿》一书所作的评论进行辩证的再分析。全文以矛盾辩证法为元语言展开解释。     

The foundation of the Turkish National Student Union and the attendance of the International Student Union at the Second Warsaw Congress

Abstract

In the early twentieth century many countries across the world established national student unions and sent representatives to the International Student Union. Believing this to be a fundamental need in a globalising world, the new Turkish state did not wait long before joining this union. In fact, several student associations in Turkey attended events run by the Turkish National Student Union, which was founded in the 1920s. Several student associations that had existed before the Turkish National Student Union and were founded by university students after the Second Constitutional Period, began to organise events such as debates, protests, and conferences related to the political, social, and cultural issues of the day. For instance, they organised protests against those teachers who did not support the national struggle. In 1924, these disparate unions, having previously functioned without any particular structure, were re-constituted as a national union, the Turkish National Student Union. The code of practice of this union was formed by looking at those of the unions of several European nations. Some members of this union attended the Warsaw meeting of the International Student Union in September 1924 to represent Turkey. It could be said that a culturally transformed and newly reformed Turkey was thereby presenting itself to the international world of education. The realisation of this project and Turkey’s participation in the Second Warsaw Congress is discussed in this article. Printed sources and reports of the period also allow us to take into consideration the foundation history of the Student Union established in 1919.     

Fachhochschulen – keine Erwachsenenbildungseinrichtungen iSd BG über die Förderung der Erwachsenenbildung

Die wirtschaftliche Abh?ngigkeit, welche ihren sinnf?lligen Ausdruck im Fehlen der im eigenen Namen auszuübenden Verfügungsmacht über die nach dem Einzelfall für den Betrieb wesentlichen Einrichtungen und Betriebsmittel findet, ist bei entgeltlichen Arbeitsverh?ltnissen die zwangsl?ufige Folge pers?nlicher Abh?ngigkeit. Fachhochschul-Studieng?nge sind Studieng?nge auf Hochschulniveau, die einer wissenschaftlich fundierten Berufsausbildung dienen. Einrichtungen der Erwachsenenbildung dienen dem gegenüber – iS einer st?ndigen Weiterbildung – der Aneignung von Kenntnissen und Fertigkeiten sowie der F?higkeit und Bereitschaft zu verantwortungsbewusstem Urteilen und Handeln und der Entfaltung der pers?nlichen Anlagen; bei derartigen Einrichtungen handelt es sich um ein deutlich niederschwelliges und sehr breit gef?chertes, insbesondere nicht prim?r auf Berufsausübung zugeschnittenes Bildungsangebot. Der Umstand allein, dass manche Fachhochschul-Studieng?nge spezifisch auf Erwachsene, insbesondere auf tagsüber bereits im Berufsleben stehende Personen zugeschnitten sind, macht sie noch nicht zu Einrichtungen der Erwachsenenbildung im Begriffsverst?ndnis der einschl?gigen sozialrechtlichen Vorschriften.

《艺术作品的本源》是海德格尔的诗学名作，它以“存在在其存在中成其本质”的存在主义立场、以“回到事情本身”和“直接呈现”的现象学方法，围绕“存在之真理”，在对“艺术的存在”的追问中，将“艺术的本质”界定为通过“世界与大地的原始争执”的“裂隙”的“构形”所实现的“真理之自行置入作品”。艺术乃“真理之生成与保存”，是真理之创建、发生和进入存在的突出方式。
