论国外作品名称的法律保护及其对我国的启示

国外对作品名称采取了不同的法律保护方法，其保护范围的确定以作品名称的独创性判断标准为依据．在我国，只有在反不正当竞争法中能找到有关保护作品名称的明确规定，这对作品的创作与发展极为不利．因而在我国，作品名称应当受到著作权法的保护，其保护范围应当依据“体现作者智力投入”的独特性判断标准为依据来确定．同时，为了更加明确这一标准，在立法上应当列举不予保护的作品名称．

在社会现代化与全球化进程中 ,如何处理好“全球一体化”与“文化多元化”的矛盾 ,是当代人类社会面临的主要挑战之一。关注现代化进程中的少数民族传统文化 ,运用法律手段保护少数民族传统文化是时代赋予我们的使命。为此 ,正确认识少数民族传统文化的特点 ,明确少数民族传统文化法律保护的原则 ,确立少数民族传统文化法律保护的内容及其规范体系具有重要意义。

Self-regulation of homework behaviour: relating grade,gender, and achievement to homework management

Abstract

The present investigation linked grade, gender, and maths achievement to homework management strategies using data from 305 Chinese students in grades 7, 8, and 9. These strategies included arranging the environment, managing time, handling distraction, monitoring motivation, and controlling potentially interfering emotion. A three-way MANOVA examined the effects of grade, gender, and maths achievement on homework management strategies. Grade or gender was not related to homework management strategies. Meanwhile, high-achieving students (compared with low-achieving students) were more likely to arrange the environment, manage time, handle distraction, monitor motivation, and control negative emotion.

美国知识产权保护规则的新一轮变迁——以《双边投资协定》为拓展的保护手段

为应对经济发展需求,美国不断在全球推行高标准、宽范围、强制约的知识产权保护制度,引发了现代知识产权国际保护规则的新一轮变迁。BIT作为知识产权国际保护的一种重要形式,在投资争端解决机制、技术化本地措施、政府竞争中立等方面都对知识产权予以强保护。通过对2012年BIT范本中知识产权保护新议题的研究,探讨知识产权保护规则的未来趋势,为我国在调整争议解决机制、待遇适用标准和政府管制范围等方面提供建议,以应对美国知识产权保护新规则带来的挑战。     

Overview of Preventive Conservation Research Work on Seismic Mitigation and Subway Vibration Control in Chengdu Museum of China

ABSTRACT

The 2008 Wenchuan earthquake brought numerous issues to the attention of researchers of seismic mitigation in Chinese museums. After the Wenchuan earthquake, the structural design team of Chengdu Museum conducted a series of research projects on seismic mitigation and subway vibration control design of buildings. These projects included the following topics: optimization of design, numerical simulation of seismic performance, analysis of key technologies for the base isolation structure, in-depth studies on structural vibrations caused by the nearby subway, and proposals for reducing structural vibrations. In 2015, after the superstructure of Chengdu Museum was completed, conservators evaluated the safety of permanent exhibitions under earthquake conditions. Seismic protection devices were installed on the showcases according to the preventive conservation requirements for museum collections. Reinforced measures were used for museum collections according to the methods suggested in the document ‘Specification for seismic protection of museum collection’ (WW/T 0069-2015). The conservators also built a systematic platform for earthquake monitoring for museum collections. Preventive conservation studies on seismic protection and subway vibration control in Chengdu Museum are summarized and forecasted.

引用许可的引入和推广对我国出版业的版权保护和期刊的健康发展具有重要的现实意义。基于文献调研和网站调研的分析结果表明,国内期刊尚未普遍引入和形成引用许可申请准则,对版权保护不够重视;而国外期刊的引用许可申请较为完善和规范,可适用于不同场景下的引用许可要求。对国内期刊而言,为建设世界一流期刊,各专业领域期刊需加强版权保护意识,率先形成本领域内的引用许可共识;并结合自身发展和国际成熟经验,推广切实可行的引用许可准则,有助于加快学术出版、促进学术交流、规范学术道德,提升国际影响力。     

The long-term preservation of identifiable personal data: a comparative archival perspective on privacy regulatory models in the European Union,Australia, Canada and the United States

This article analyses the extent to which archival exemptions for historical, scientific and statistical research in privacy legislation support preservation in selected European Union countries, and comparable aspects of Australian, American and Canadian law within a legal, ethical and digital archival perspective. The authors recommend that the further processing of personal data under data protection law be given a wider scope of interpretation for archival preservation purposes in both the public and private sector, coupled with the use of researcher and archival codes in relation to access to personal data. They also recommend early appraisal and integration of privacy with freedom of information and archival regimes.
