定罪与量刑的关系模式是我国量刑程序改革理论上的争点与实践中的难点。探寻一种适合我国国情的定罪与量刑关系模式,对推动我国量刑程序改革的深入进行有着非常重大的意义。对于被告人认罪案件,各界普遍认为应适用相对独立的量刑程序,目前专家学者们的分歧在于对被告人不认罪的案件应适用相对独立的量刑程序还是独立的量刑程序。各地方法院量刑程序改革试点的实践证明,对于被告人不认罪案件的审理,独立的量刑程序更具科学性与合理性。  相似文献

This article focuses on (a) distinctions between the profoundly gifted individual and others, and (b) a chart describing tendencies and/or behaviors associated with the profoundly gifted student in common, mixed-ability educational settings. The intent is to provide educators, parents, and policymakers with preliminary awareness about the unique behaviors and tendencies of the profoundly gifted learner in heterogeneous educational settings. Learners with measured IQ scores greater than 3 SD units above the mean are a statistical rarity—outliers—in most educational settings. The current inability of most educators to identify and even minimally address needs leaves these students anxious, frustrated, and otherwise unable to reach their intellectual capacity in the majority of school settings across the country. Focused research and careful attention to the nature and needs of these individuals throughout their lives can contribute substantially to our developing understanding.  相似文献

兴奋剂问题的高学历化倾向日益引起社会对高校竞技运动发展的担忧,而针对高校兴奋剂问题的干预,将其关在规则的牢笼里具有重要的社会价值和现实意义。本研究基于双态度理论模型,采用自我报告和IAT实验深入地分析高校运动员兴奋剂使用的内在驱动机制和容忍度,并提出侧重高校大学生认知和行为层面的干预,强化其规则意识以及降低其对兴奋剂的容忍度是促进高校竞技体育回归本原的重要着力点,进而更好的实现运动员、竞技体育和整个社会的和谐发展。  相似文献

Inquiry is essentially a process in which research questions are asked and an attempt is made to find the answers. However, the formulation of operational research questions of the sort used in authentic scientific inquiry is not a trivial task. Here, we set out to explore the possible influence of separating the research question from the laboratory techniques used to try and answer this question on teachers' understanding of laboratory techniques and their ability to formulate research questions. We conducted a laboratory course in microbiology in which the laboratory techniques were presented in an explicit and generalized manner, in the context of specific research questions. During the course, teachers' understanding of laboratory techniques improved as reflected in their answers to exercises given throughout. In addition, teachers' ability to ask research questions, analyzed using Dillon's classification of research questions, also improved. When reflecting upon the course, some teachers attributed the change in their ability to ask research questions to their increased knowledge of techniques, whereas others did not. We conclude that to facilitate research‐question‐asking skills among teachers, they should be provided with knowledge of the relevant laboratory techniques in an explicit fashion. © 2012 Wiley Periodicals, Inc. Drawing on procedural justice research from social psychology, this study explores the role that journalistic practice plays in telling community members about whether local politicians are behaving fairly. Qualitative interviews with 24 community journalists working in cities in Upstate New York are used to answer the following research questions: (1) how does content regarding authority fairness find its way into news stories, and (2) what facets of justice—whether distributive, voice, or relational—do journalists emphasize. The interviewed journalists said that they often used their evaluation of local politicians’ fairness in deciding whether to pursue a story. In doing so, these journalists highlighted questions of whether politicians were listening to community members and the degree to which they appeared to take the best interest of citizens to heart. There was little agreement among journalists about the degree to which citizens could adequately make fairness judgments based on local news coverage, although the television reporters believed that television's visual component provided key information about the fairness of local politicians.  相似文献

Research in attribution theory has almost exclusively focused on the perception process to the neglect of studying how communicators incorporate attribution‐based information in their message behavior. This study derived a typology of attribution‐based strategies from Kelley's attribution cube and Jones' ingratiation tactics to assess respondent strategies for initiating and for terminating same‐sex friendships. Respondents were 191 persons drawn from fifth grade, high school, college, and post‐college groups. Results of the study included: 1) distinctiveness information was disproportionately employed in the strategy repertoires to the neglect of consistency‐based and consensus‐based information; 2) respondents had greater variety in types of strategies for their initiation repertoires as opposed to their termination repertoires; 3) repertoire variety for both initiation and termination increased from childhood through adolescence.  相似文献
