关于确立我国竞技体育纠纷解决有限自治原则的思考

司法介入竞技体育纠纷的理论障碍主要在于体育纠纷解决自治原则,德日特别权力关系理论给该原则以理论支持,然而今天,特别权力关系理论已经势微,我国体育纠纷解决自治原则缺乏中立的体育仲裁制度保证,且其本身过于绝对,再加上我国现行体育社团内部解决机制因受体育行政权的制约而缺乏独立性。故应当确立我国竞技体育纠纷解决有限自治原则,并通过修改相关法律和章程、设立独立的体育仲裁机构和体育法院来实现。     

欧盟国家体育协会与政府的关系研究及借鉴

体育事业作为国家综合国力的重要内容,越来越受到国家的重视和扶植。体育协会在特定体育领域的发展中发挥着重要作用。体育协会作为群众性组织的一个重要特点是其自治性,这也是其充分发挥作用的前提。但是世界各国政府对体育协会都进行管理和控制。欧盟作为体育协会制度发展较完善的区域,其各成员国政府对待体育协会的态度也不尽相同。我国政府长期以来对体育协会的干预过多,影响了体育协会作用的发挥。研究欧盟体育协会自治与政府干预的关系有助于在修改《体育法》及相关法律法规时借鉴欧盟的经验和教训,更好地处理体育协会自治与政府的关系,实现体育协会功能发挥的最大化。     

软法与高校人力资源管理

软法是伴随着公域治理模式的转型而出现的一种思潮和规范现象。在事业单位改革和高校去行政化的背景下,运用软法的精神和机制能够消解高校人力资源管理的行政化倾向,塑造其民主自治品格。在制度建设方面,软法应该协调国家法,成为高校人力资源制度制定和实施过程中的导控性装置。     

基于主体性发展的师范生课堂教学模式探究——以《师范素养修习》课程为例

师范生的主体性发展,是对师范生主动、积极的自我发展的诉求。课堂教学以师范生的主体性发展要求为前提,也是塑成师范生这一主体性的成长的主阵地。《师范素养修习》课程以"教学做合一"为核心思想,以中国传统的"学——思——行"模式为指导,尝试建构一种以所"学"、所"思"引领所"行",以所"行"验证所"学"、所"思"的课堂教学模式。模式有调整心理氛围、创设研修情境,自修致知——求疑辩难——学思相资,知行合一——事上磨炼——自律力行三个主要环节,依凭对话、讨论、反思、质疑等主要方法,对参与研修的师生双方的主体性成长均有一定的促进作用。     

Does school context matter? Relations with teacher burnout and job satisfaction

This study examined relations between teachers' perception of the school context, teacher burnout, and teacher job satisfaction. Participants were 563 Norwegian teachers in elementary school and middle school. Four aspects of teachers' perception of the school context (supervisory support, time pressure, relations to parents, and autonomy) and three dimensions of teacher burnout (emotional exhaustion, depersonalization, and reduced personal accomplishment) were measured. The data were analyzed by means of structural equation modelling using the AMOS 5 program. Teachers' job satisfaction was directly related to two of the dimensions of burnout (emotional exhaustion and reduced personal accomplishment) and indirectly related to all aspects of the school context, through emotional exhaustion and reduced personal accomplishment. The three dimensions of burnout were differently related to the school context variables. Emotional exhaustion was most strongly related to time pressure whereas depersonalization and reduced personal accomplishment were most strongly related to teachers' relations with parents. Implications for both research and educational practices are discussed.     

法律自治的三重意境

就法治的解构与分析而言,法治是一个动态的运作机制。贯穿于这种运作机制的始终不可或缺的主线就是法律自治。法律自治既是法治的题中之意,又是通向法治之境的路径。法律自治包括三重意境,即法律的权威来自法律、法律人是法律自治的动因、法律自治要求平等待人。     

The effects of choice in the classroom: Is there too little or too much choice?

Motivation is a subject that is constantly discussed in the field of education. Teachers are taught not only to teach their students, but to motivate them to want to learn. As students get older, intrinsic motivation tends to decrease; therefore it becomes more difficult for teachers to motivate students (Ryan and Deci, 2000a). According to self‐determination theory (Ryan and Deci, 2000a, 2000b), students' needs for autonomy, competence and relatedness must be met in order to experience positive social development and growth. When these needs are met, students experience high levels of self‐motivation. Offering choice in the classroom is one way to increase student motivation by appealing to students' needs for autonomy and competence. In the fields of marketing, economics and social psychology, decision‐making research is examined as a way to shape consumers' preferences. This literature review will aim to utilise and possibly translate some of these findings to an educational setting. By examining the aspect of choice in separate fields, it can be seen that there is still much to be researched in the field of education. Recommendations for future research on choice in the field of education are made.     

Taiwanese technical education teachers’ professional development: An examination of some critical factors

There is a lack of research in the area of the influence that task autonomy (TA), organizational learning (OL), and group cohesiveness (GC) can have on technical education teachers' innovation of professional development (IOPD). Therefore, this study aimed to probe into the influences of TA, OL, and GC on IOPD by technical education teachers, and their relationships. We conducted a questionnaire survey on 265 full-time teachers. The results showed that TA, GC, and OL of technical education teachers revealed significant positive relationships with the degree of IOPD. The teachers' TA and OL are critical factors to their IOPD, as they are positive predictors.     

元认知在基于网络的大学英语自主学习中的作用及培养途径

本文从基于网络的大学英语自主学习的特点以及现存的问题入手,分析了元认知在这一学习模式中所起的积极作用,提出了如何通过培养学生的元认知,以提高其自主学习的能力。     

张世英与清末秦州地方自治

宪政运动是清末新政的重要内容之一,地方自治是其基础。甘肃宪政运动因前任总督升允的抵制而迟滞不前,升允在被开缺之后,继任者长庚出于时间紧迫,便采取变通作法,一边为地方自治做准备,一边调在陕西渭南作知县、在任期间自治已办有成效的张世英来甘,先在其本籍秦州试办。由秦州自治规划及其依凭的思想资源大致反映出主持者对地方自治的基本理念,同时从秦州自治引发的社会各阶层的反应中也能了解清末当地的一些社会状况。
