浅论诚信执法与其实现

完善行政执法是构建社会主义和谐社会的重要内容。文章从目前行政执法的现状入手,在分析其原因的基础上,提出确立以诚信为特征的行政执法新理念,并对诚信理念引入行政执法进行了探讨论证。     

论ATM机跨行取款费上涨的法律性质——兼论对经营者滥用市场支配地位的认定和规制

我国四大国有银行有相继提高ATM机跨行取现手续费标准的经营行为。根据我国《反垄断法》的有关规定，应当原则禁止经营主体滥用市场支配地位行为。经营者是否滥用市场支配地位首先要判断经营者是否处于市场支配地位，是否存在滥用行为，是否存在损害事实，滥用行为与损害事实之间是否存在因果关系。根据反垄断法规定，由反垄断执法机构依法对涉嫌垄断行为进行调查，认为构成垄断行为的，应当依法作出处理决定，并可以向社会公布。我国应不断完善有关法律规定，以使通过私人诉讼遏制经营者实施垄断行为成为可能。通过规制滥用市场支配地位的行为，可以更好地维护市场竞争，提高经济效益，实现消费者利益最大化。     

Friendships for wellbeing?: parents’ and practitioners’ positioning of young children’s friendships in the evaluation of wellbeing factors

ABSTRACT

Friendship matters for young children’s development, learning and experience of wellbeing. This paper emphasises the significance of young children’s friendships for their wellbeing, especially in the context of early years settings. Findings are presented from two online questionnaires developed for the project, in which 155 parents/carers and 285 practitioners in England expressed their perceptions of what matters for young children’s wellbeing. Data shows some ambivalence in the views of both parents/carers and practitioners about the importance of friendship in this context. Both groups gave low prioritisation to ‘the company of friends’ for children’s wellbeing. As friendships are of central importance to young children themselves, this could suggests that adults and children may have different priorities, which raises questions about the extent to which young children’s friendships are seen as important by adults. The paper concludes by proposing the need for practitioners in particular, but also parents, to consider their roles and priorities for children’s lives within schools and nurseries, including how they might sensitively support and facilitate children’s friendships in play, activities, transition and everyday life.

英语严格遵循主谓结构的要求, 而汉语则遵循话题—说明的结构要求, 因此, 英汉翻译过程中主谓结构向话题—说明结构的转换是不可避免的。通过对英汉语结构的对比分析, 探讨法律翻译中主谓句向话题—说明句转换的几种方法。     

Understanding higher education-based teacher educators’ identities in Hong Kong: a sociocultural linguistic perspective

While teacher educator identities have received increasing attention over the past decade, there is a lack of research on teacher educators’ professional identities in the complex and shifting higher education contexts. Informed by the sociocultural linguistic perspective, this study investigates two language teacher educators’ professional identities in Hong Kong universities. The findings show that the participants discursively constructed their identities, such as “accidental teacher educator,” “teacher educator-researcher,” “struggling researcher,” “teacher of teachers,” and “inactive researcher” in their professional work. By drawing on the three interrelated processes of identity formation (i.e. adequation/distinction, authentication/denaturalisation, and authorisation/illegitimation), the study adds to our knowledge of the complex and contested nature of teacher educator identity in relation to the ongoing restructuring and reform in higher education. The study concludes with some implications for teacher education and higher education.     

我国国有商业银行的不良贷款现状及其法律对策

大量不良贷款是困扰我国国有商业银行的主要问题，本文从法律的角度对我国国有商业银行不良贷款的现状进行了分析并提出了相应的对策。     

Do Parents Benefit? Perspectives of Low-Income Parents Who Received a Free Early Readiness Program for Their Child

The purpose of this study was to discover the interpretations and perspectives of 4 low-income parents who received a free early readiness program for their child. Two interviewees were parents who had a child enrolled the year data was collected, and the other two interviewees were parents whose children had participated previously in the early readiness program. The results of this study show that the early readiness program offered benefits to the parents as well as the child, regardless of enrollment year. The benefits include, but were not limited to, social support for parents, financial assistance, greater understanding of their children, and practical parenting ideas. The findings of this study supported the value of free early readiness programs for low-income parents. The discussion substantiates the findings of this study with previous research and concludes there were several identifiable benefits for the parents.     

仅有夫妻二人股东能否具备有限责任公司资格

随着公司制度的推行，各种公司纠纷案件迅速增加。当一个公司仅剩下夫妻股东时。该公司是否还具备法人资格?公司设立时能否由夫妻二人作为公司仅有的股东?这些问题我国公司法并未做明确的规定。笔拟就这些问题谈谈自己的看法。

新闻学的本质是故事,用故事讲述新闻是新闻回归事实的新取向。本文首先分析了新闻的本质是故事,然后阐释了用故事讲述新闻的意义,并从新闻采访和新闻写作两个层面论述了用故事讲述新闻的途径。应该说,用故事讲述新闻,在娱乐化的基础上提升了新闻的内涵,拓展了新闻的影响力,使新闻更具有魅力。     

浅议现阶段公安机关依法录警中的不经济警训行为表现

现阶段我国公安机关依法录警中存在的不经济警训行为，削弱了警察录用应有的积级作用。鉴于此．我们提出立体滚动式录用机制的构思，促使录用晋升机制与教育培训机制有机结合．期望借此能够有助于问题的解决，完善依法录警程序。
