论未成年人合法权益的保障

未成年人在社会中处于弱势地位。一方面，他们从心理上正处于从无知到有知、从不成熟到成熟的转变时期，心理上比较脆弱，更容易受到外界的诱惑和外界的侵犯；另一方面，我们这个社会还是一个以成年人为中心的社会，所制定的法律政策的主要参照物是成人，对未成年人考虑得不够。这两方面原因导致了对未成年人的保护重视不够。本文分析了未成年人问题的成因和保护现状，提出了一些保障未成年人合法权益的途径。     

Reconceptualizing the pedagogical value of student facilitation

Sustained discourse is critical to the learning potential of online courses. And, while research has surfaced many factors that mediate interaction, it further suggests that sustained interaction remains elusive. In this paper, I propose that student facilitation may have an impact on the quality of facilitators' interactions following a week of moderating a course discussion. Through a survey of students in two post-secondary online courses, the results suggest that moderation fosters understanding of online learning processes and enhances interaction with others and content. I therefore suggest that moderation acts to inculcate students into the social fabric of an online course, prior to which their role and performance is ill-defined.     

犯罪构成要件的位阶性

大陆法系和英美法系的犯罪构成要件之间具有位阶的效力,这种位阶效力要归功于正当化事由的纳入,而我国犯罪构成是一种耦合式的犯罪构成,各个要件之间没有位阶关系。我国的正当化事由被排除在犯罪构成要件之外,而我国的犯罪构成又是一种实质性的犯罪构成,这不仅引起逻辑上的矛盾,还造成实践上对正当化事由的忽视,不利于保护被告人。因此,笔者建议将本属于犯罪构成要件的正当化事由纳入到构成要件之中,使得我国的犯罪构成具有位阶性。     

双语与政治关系研究述评

双语的存在和发展同一个国家的政治和种族群体的基本信仰紧密相连,国家的政治主张和群体的政治要求都会促进或抑制双语教育的进程.从国外学者提出的建立在双语政治和双语教育基础之上的三个基本观点,以及人们对少数语种的态度可以看出,语言不仅仅是一种交际工具,而且从侧面反映了一个国家的政治制度,还构成种族和身份的象征.     

后现代知识与“游戏”

“利奥塔把后现代知识状况描述为对思辨与解放“元叙事”的质疑,实质上是以“解合法化”与“悖论逻辑”对作为“共识”之公共游戏规则的消解,从维特根斯坦到利奥塔完成了对古典“游戏”说的颠覆。这与新实用主义罗蒂以“小”叙事达成的“共识”代替“大（哲学－哲学家）”,从不同的极端,在异质－多元的语言游戏中颠覆着真理,建立起众“小”的迪斯尼乐园,西方的马克思主义, 如杰姆逊、伊格尔顿等,对此进行了批判。从利奥塔提出的五点知识本性改变可见,后现代信息革命并没有改变知识的真理性本性。

我国商品房制度建立以来,“按揭”就成为理论和实践争论不息的热点问题。该文论述了“按揭”引入的法律背景,现行运作的方式,以及存在并亟待解决的问题,在法律定位上提出了自己的见解。     

高校学生工作中程序合法性缺失探讨——以学生申诉和听证制度为考察点

我国高校学生工作人员普遍缺乏对"正当程序"理论的真正理解,往往对程序合法性处于表面肤浅的实践,工作往往产生了"走过场,做样子"的"程序形式性"做法,致使高校学生工作程序合法性缺失问题仍然普遍存在.因此,重点以高校学生申诉和听证制度存在的瑕疵为参考点,分析其他学生工作程序合法性缺失问题,提出探索性的思路和理性的思考.     

Legitimate,expert and referent power in physical education

Physical Education (PE) in school aims to help pupils experience the joy of movement through various forms of physical activity and to acquire a positive attitude to physical activity and exercise. The teacher's task is to mediate the joy of movement and instil a positive attitude to exercise in the pupils. Drawing on the methodology of van Manen [(2002). Writing in the dark: Phenomenological studies in interpretic inquiry. London: The Althouse Press], this article takes a closer look at mediating the joy of movement and conveying attitudes through legitimate, expert and referent power [French, J. R. P., & Raven, B. (1959). The bases of social power. In D. Cartwright (Ed.), Studies in social power (pp. 150–167). Ann Arbor: The University of Michigan] as narrated by an experienced Norwegian PE teacher. The teacher's narrative is interpreted within a framework where these typologies of power refer to the teacher's formal position in PE classes and the teacher's athletic skills and teaching qualities. The teacher's narrative indicates that legitimate, expert and referent power influence pupils’ views on PE, attitudes and effort in class. Referent power provides the potential to instil attitudes in the pupils, even to the point of getting them to enjoy taking exercise to the limit. It even embraces teachers’ potential to influence pupils by displaying their own active lifestyle, which goes beyond teaching itself. However, some problematic and unresolved issues are pointed out within this approach. A didactic approach, where the teachers use their own lifestyle as a pedagogical tool, may prompt a negative rather than a positive reaction from pupils, because they may be (mis)construed as being too eager and physically active to the extreme. Referent power depends on establishing credibility with the pupils, and conveying attitudes through referent power implies a didactic instability. On the other hand, the approach may be a good strategy for achieving what teachers should be trying to achieve, which is to convey and instil the joy of movement and a positive attitude to physical exercise in the pupils.
